Proscribe Islam: Petition Rough Draft


Updated November 2, 2012 to repair broken  links.  The New

This document, an edited version of the original
rough draft of the petition, may be used as an email attachment.
Its full quotations and links make it a good educational tool for
persons unfamiliar with the canonical texts of Islam.

Whereas Islam and its apologists accuse Kuffar of inculcating hatred of
Muslims and inciting violence against them;  and

Whereas Islam is pursuing national and international legislation to impose
their blasphemy laws upon us so as to prevent or punish exposure of
their execrable doctrines which inculcate hatred, incite violence and
sanctify & mandate genocidal, terroristic conquest; the intent of
which legislative campaign is to render us defenseless;

Now, therefore, the undersigned Kufar & Harbi [Infidels & war
victims.] do declare, swear and demonstrate proof from the ample
testimony of Allah and his Messenger that Islam is and will always be
in egregious violation of the recognized rights of free men and must
therefore be condemned and proscribed:

ICERD.
[Emphasis added.]

Article 4

States Parties condemn all propaganda and all organizations which are based on
ideas or theories of superiority of one race or group of
persons of one colour or ethnic
origin, or
which attempt to justify or promote racial hatred and discrimination in
any form, and undertake to adopt immediate and positive
measures designed to eradicate all incitement to, or acts
of, such discrimination and,
to this end, with due regard to the principles embodied in the
Universal Declaration of Human Rights and the rights expressly set
forth in article 5 of this Convention, inter alia:

(a) Shall declare an offence
punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial
discrimination, as well as all
acts of violence or incitement to such acts against any race or group
of persons of another colour or ethnic origin, and also the
provision of any assistance to racist activities, including the
financing thereof;

(b) Shall declare illegal and prohibit
organizations, and also organized and all other propaganda activities,
which promote and incite racial discrimination, and shall
recognize participation in such organizations or activities as an
offence punishable by law;

(c) Shall not permit
public authorities or public institutions, national or local, to
promote or incite racial discrimination.

States Parties condemn all propaganda and all
organizations which are based on ideas or theories of superiority of
one race or group of persons of one colour or ethnic
origin,

Islam must be condemned and its propagation banned  because of the
following egregious violations of Art. 4. [Noble Qur’an, trans. Hilali
& Khan, emphasis added for clarity.]

3:110. You [true believers in Islâmic
Monotheism, and real followers of Prophet Muhammad  and his Sunnah
(legal ways, etc.)] are the best of peoples ever raised
up for mankind; you enjoin Al-Ma’rûf (i.e. Islâmic Monotheism
and all that Islâm has ordained) and forbid Al-Munkar (polytheism,
disbelief and all that Islâm has forbidden), and you believe in Allâh.
And had the people of the Scripture (Jews and Christians) believed, it
would have been better for them; among them are some who have faith,
but most of them are Al-Fâsiqûn (disobedient to Allâh – and rebellious
against Allâh’s Command). 1

Allah
said that Muslims are the best
of peoples. What exactly is the meaning of this ayeh? An oral
tradition collected by Bukhari delivers the exegeses from the lips of
Muhammad.

Sahih Bukhari Volume
6, Book 60, Number 80:

Narrated
Abu Huraira:

The
Verse:–”You (true
Muslims) are
the best of peoples ever raised up for mankind.” means, the
best of peoples for the people, as you bring them with chains on
their necks till they embrace Islam.2

Clearly, 3:110 is an
expression of ethnic supremacism directly linked to military aggression
which deprives its victims of freedom of religion.

Muslims
enjoin all that Islam has ordained and forbid disbelief &
everything Islam has forbidden. Muslims bring the people with chains on
their necks until they embrace Islam. This expression of
aggressive supremacism & triumphalism subjects Islam to
condemnation.

or which attempt to justify or promote racial
hatred and discrimination in any form, and undertake to adopt
immediate and positive measures designed to eradicate all incitement
to, or acts of, such discrimination

2:91.
And when it is said to them (the Jews), “Believe in what Allâh has sent
down,” they say, “We believe in what was sent down to us.” And they
disbelieve in that which came after it, while it is the truth
confirming what is with them. Say
(O Muhammad Peace be upon him to them): “Why then have you killed the
Prophets of Allâh aforetime, if you indeed have been believers?”3

98:6.
Verily, those who disbelieve (in the religion of Islâm,
the Qur’ân and Prophet Muhammad  from
among the people of the Scripture (Jews and Christians) and
Al-Mushrikûn will abide in the Fire of Hell. They are the worst of creatures.4

9:29. Fight against those who (1) believe not in Allâh,
(2) nor in the Last Day, (3) nor forbid that which has been forbidden
by Allâh and His Messenger (4) and those who acknowledge not the
religion of truth (i.e. Islâm) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with
willing submission, and feel themselves subdued.5

9:30.
And the Jews say: ‘Uzair (Ezra) is the son of Allâh, and the Christians
say: Messiah is the son of Allâh. That is a saying from their mouths.
They imitate the saying of the disbelievers of old. Allâh’s Curse be on them,
how they are deluded away from the truth!6

It
is obvious upon the face of the text that the quoted ayat incite hatred
of Jews & Christians, declare war upon them and curse them.
There can be no doubt that Islam’s canon of scripture is in
egregious violation of Article 4 and must therefore be condemned.

Under
section a quoted above, publishing or preaching from the Qur’an must be
punishable by law. Under section b quoted above, Islam must be declared
illegal and prohibited.

ICCPR,

Article
6.

Every human being has
the inherent right to life.
This right shall be protected by law. No one shall be arbitrarily deprived
of his life.

By
declaring perpetual war, Islam egregiously violates the right to life.
We know that Jihad is perpetual because the declaration is unlimited
geographically and chronologically, it is outcome oriented.
Furthermore, Islam’s founder testified to its duration.

Abu Dawud Book 14, Number 2526

Narrated Anas ibn Malik:

The Prophet
(peace_be_upon_him) said: Three things are the roots of faith: to
refrain from (killing) a person who utters, “There is no god but Allah”
and not to declare him unbeliever whatever sin he commits, and not to
excommunicate him from Islam for his any action; and jihad
will be performed continuously since the day Allah sent me as a prophet
until the day the last member of my community will fight with the Dajjal
(Antichrist). The
tyranny of any tyrant and the justice of any just (ruler) will not
invalidate it. One must have faith in Divine decree.7

Islam’s founder also testified that Islam has no respect for the sanctity of
life.

Sahih Bukhari
Volume 1, Book 8, Number 387:

Narrated Anas bin Malik:

Allah’s Apostle said, “I have been ordered to fight the people till
they say: ‘None has the right to be worshipped but Allah.’ And if they say so, pray
like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will
be sacred to us and
we will not interfere with them except legally and their reckoning will
be with Allah.” […]8

Article
20
  1. Any propaganda for war
    shall be prohibited by law    .
  2. Any advocacy of national, racial or
    religious hatred that constitutes incitement to    discrimination, hostility or violence shall be prohibited
    by law.

20.1
proscribes propaganda for war; 20.2 proscribes advocacy of incitement
to hostility.

8:39. And fight them until there is no more
Fitnah (disbelief
and polytheism: i.e. worshipping others besides Allâh) and the religion (worship)will all be for Allâh Alone [in
the whole of the world ]. But if they cease (worshipping others besides
Allâh), then certainly, Allâh is All-Seer of what they do.9

9:29. Fight against those who (1) believe not in Allâh, (2)
nor in the Last Day, (3) nor forbid that which has been forbidden by
Allâh and His Messenger (4) and those who acknowledge not the
religion of truth (i.e.
Islâm)among the people of the
Scripture (Jews
and Christians), until they pay the Jizyah with
willing submission, and feel themselves subdued.10

9:123.
O you who believe! Fight those of the disbelievers who
are close to you, and let them find harshness in you, and know
that Allâh is with those who are the Al-Muttaqûn (the pious – see
V.2:2).11

Those are direct commands to conduct aggressive warfare. The oral traditions
of Moe’s companions give ample confirmation of that fact.

Sahih Bukhari Volume 4, Book 52, Number 196:

Narrated Abu Huraira:

Allah ‘s Apostle said, ” I have been ordered to fight with
the people till they say, ‘None has the right to be worshipped but Allah,’
and whoever says, ‘None has
the right to be worshipped but Allah,’ his life and property will be saved
by me except for Islamic law, and his accounts will be with
Allah, (either to punish him or to forgive him.)”12

9:38.
O you who believe! What is the matter with you, that
when you are asked to march forth in the Cause of Allâh (i.e. Jihâd)
you cling heavily to the earth? Are you pleased with the
life of this world rather than the Hereafter? But little is the
enjoyment of the life of this world as compared with the Hereafter.13

9:39. If you march not forth, He will
punish you with a painful torment and will replace you
by another people, and you cannot harm Him at all, and Allâh is Able to
do all things.14

Allah told the Muslims that they could go to Jihad or go to Hell. Of course,
there is another side to this: the “commerce” that will save Muslims
from the fire.

61:10.
O You who believe! Shall I guide you to a commerce that will save you from a
painful torment.15

61:11.
That you believe in Allâh and His Messenger (Muhammad), and that you strive hard and fight
in the Cause of Allâh with your wealth and your lives, that will be better for
you, if you but know!16

61:12.
(If you do so) He will forgive you your sins, and
admit you into Gardens under which rivers flow, and pleasant
dwelling in Gardens of ‘Adn ­ Eternity [‘Adn (Edn) Paradise], that is
indeed the great success.17

9:39 tells Muslims of a painful torment to befall them if they do not join
the Jihad. 61:10 tells them of a “commerce” that will save them from
painful torment: joining the Jihad, which will be rewarded with
admission to Paradise. This carrot & stick approach is obviously incentivising Jihad.
It is obvious that the Qur’an is propaganda for war,
which must be prohibited.

The
Qur’an tells us that it can not be changed.

6:115.
And the Word of your Lord has been fulfilled in truth and in
justice. None
can change His Words. And He is the All­Hearer, the
All­Knower.18

30:30.
So set you (O Muhammad ) your face towards the religion of pure Islâmic
Monotheism Hanifa (worship none but Allâh Alone) Allâh’s Fitrah (i.e.
Allâh’s Islâmic Monotheism), with which He has created mankind. No change let there be in Khalq­illâh (i.e. the Religion of Allâh
Islâmic Monotheism), that is the straight religion, but most of men
know not. [Tafsir At­Tabarî, Vol 21, Page 41]19

The
Qur’an is a violation of international law and it can’t be edited;
preaching it and propagating its doctrines must therefore be
prohibited.  One of the cited ayat: At-Taubah 29, is cited as the
scriptural basis of  Reliance
of the Traveller Book
O, Chapter 9, Paragraph 8 which Islamic law declares that the Caliph
makes war upon Jews, Christians and Zoroastrians.

O9.8: The Objectives of Jihad

The caliph (o25) makes war upon
Jews, Christians, and Zoroastrians (N: provided he has first
invited them to enter Islam in faith and practice, and if they will
not, then invited them to enter the social order of Islam by paying the
non-Muslim poll tax (jizya, def: o11.4) -which is the significance of
their paying it, not the money itself-while remaining in their
ancestral religions) (O: and the war continues) until they become
Muslim or else pay the non-Muslim poll tax (O: in accordance with the
word of Allah Most High,

“Fight those who
do not believe in Allah and the Last Day and who forbid not what Allah
and His messenger have forbidden-who do not practice the religion of
truth, being of those who have been given the Book-until they pay the
poll tax out of hand and are humbled” (Koran 9.29),

the time and
place for which is before the final descent of Jesus (upon whom be
peace). After
his final coming, nothing but Islam will be accepted from them, for
taking the poll tax is only effective until Jesus’ descent (upon him
and our Prophet be peace), which is the divinely revealed law of
Muhammad. The coming of Jesus does not entail a separate divinely
revealed law, for he will rule by the law of Muhammad. As for the
Prophet’s saying (Allah bless him and give him peace),

“I am the last,
there will be no prophet after me,”

this does not
contradict the final coming of Jesus (upon whom be peace), since he
will not rule according to the Evangel, but as a follower of our
Prophet (Allah bless him and give him peace) ).

Islamic
law clearly requires making war upon non-Muslims.  O9.1 describes it as a communal obligation which
must be performed yearly.

[…]If none of those concerned perform
jihad, and it does not happen at all, then everyone who is aware that
it is obligatory is guilty of sin, if there was a possibility of
having performed it. In the time of the Prophet (Allah bless him and
give him peace) jihad was a communal obligation after his emigration
(hijra) to Medina. As for subsequent times, there are two possible
states in respect to non-Muslims.

The first is when
they are in their own countries, in which case jihad (def: o9.8) is a
communal obligation, and this is what our author is speaking of when he
says, “Jihad is a communal obligation,” meaning upon the Muslims each year.[…]
{Hedaya 2:9:141 states that: “The destruction of the sword  is
incurred by infidels, although they be not the first aggressors,
as
appears from various passages in the  sacred writings which are
generally received this effect.”}

The
annual obligation of Jihad is confirmed in Shafi’ite fiqh.

Al-Shafi’i (God
have mercy on him) said: “The
least that the imam must do is that he allow no year to pass without
having organised a military expedition by himself, or by his raiding
parties, according to the Muslims’ interest, so that the jihad
will only be stopped in a year for a (reasonable) excuse.” He said: “If
he did not undertake the sending of enough troops to fight, those who
are absent (must) go out, and consider as an obligation that which God

Jihad,  an intrinsic sacrament of Islam, is mandatory, not
optional.

2:216. Jihâd (holy fighting in
Allâh’s Cause) is ordained for you (Muslims) though you
dislike it, and it may be that you dislike a thing which is good for
you and that you like a thing which is bad for you. Allâh knows but you
do not know.20

Muslims have been purchased by Allah, in return for admission to Paradise, so
that they fight in his cause, kill and are killed.

9:111.
Verily, Allâh has purchased of the believers
their lives and their properties; for the price that theirs shall be the Paradise.
They fight in Allâh’s Cause, so they kill (others) and are killed. It is a promise in truth
which is binding on Him in the Taurât (Torah) and the Injeel (Gospel)
and the Qur’ân. And who is truer to his covenant than Allâh? Then
rejoice in the bargain which you have concluded. That is the supreme
success .21

Islamic
tradition informs us that Jihad will continue until Judgment Day, and
that Muslims would be cursed for abandoning it.

Abu Dawud Book 14, Number 2526

Narrated Anas
ibn Malik:

The Prophet
(peace_be_upon_him) said: Three things are the roots of faith: to

Abu Dawud Book 23, Number 3455

Narrated
Abdullah ibn Umar:

I heard the
Apostle of Allah, (peace_be_upon_him) say: When you enter into the inah transaction,
hold the tails of oxen, are pleased with agriculture, and give up
conducting jihad(struggle in the way of Allah). Allah will make disgrace prevail over
you, and will
not withdraw it until you return to your original
religion.23

From
this narration, it becomes obvious that Islam and Jihad are synonymous.
Since Islam asserts a divine mandate and right to wage
war against us, to kill us, rape
our widows,enslave
our orphans and seize our real and personal property, we can not enjoy our God
given right to life.  We have shown the court that Islamic
doctrine, practice & jurisprudence violate the international
covenants which guarantee our human rights.

We
submit in evidence the ample testimony of Ibn
Kathir, through his Tafsir, which verify the fact that the meaning
of the Qur’an & Sunnah previously submitted herein is clear on its
face, neither mis-translated nor mis-interpreted.

Since
Muslims are promised eternity in a celestial
bordello for
participating in Jihad and threatened with eternal damnation if they
refuse, it is impossible that free men can live in peace and security
while Islam exists upon the face of the earth.

We therefore pray for injunctive relief::  perpetual proscription
of the practice and propagation of Islam.
