Responding to an Anonymous Cpmment on Reliance of the

of the Traveller: Handbook of Shari’ah

was published to provide information about Islamic law, known as
Shari’ah. It focuses on Reliance of the Traveller, the most widely
known and accepted codification of fiqh.   That post has been
receiving about four hits per day for several months.  I guess
that interest in Shari’ah is being aroused by the controversy over
proposed legislation to exclude foreign law from domestic court

A lengthy anonymous comment on the post needs more
attention than the comment format permits.  I am therefore
blogging it here with a post of its own. The comment is reproduced
below, unedited. My point by point response follows below the
horizontal line.

You are far from Jesus’ teachings, and especially his message of love.

You harm your self and spread hatred with your falsehoods.

You could actually benefit from the truth and the beauty of the
teachings you are slandering.

The kufar are not Christians and Jews. They are “people of the book”
meaning people who have received revelations from God, however much
they ignore them or distort them. Kufar are idol worshippers. If you
honestly read the Quran or the Hadith, leaving behind the prejudice and
hatred, you might recognize that the revelations in the Quran, the life
and teachings of Muhammad, s.a.w., and the ways laid out from these in
the shariah, flow from the same Divine sources as the best of the old
and new testaments, and the examples and teachings of Jesus, s.a.w. and
the Prophets, s.a.w..

Indeed, I found the truth of Islam first by studying the words and
actions of Jesus s.a.w., the prophet, the guide, the good shepherd, the
teacher, the lover of all men and women, good and bad, the one who
prayed, who fell down on his face in worship, and in complete
submission to God, who asked forgiveness and help from his Lord and our
Lord, his Father and our Father.

This is Islam. There is nothing more to it. This is the real Shariah as
well, as developed by Muslim lawyers from the Quran and the teachings
and example of Muhammad s.a.w, as well as the example and teachings of
the other prophets in the Quran: Ibrahim, Moses, and Jesus among others.

As for the particulars of your errors, there are too many to mention in
less than a book, but for starters:

Zakat can and was given to dhimma during the time when there were
actual Muslim countries that followed Shariah. It is mandatory, not
just allowed. (If anyone was following Shariah).

Dhimmis (non-Muslim loyal citizens of a Muslim country) were not
required (or allowed) to be in the army under shariah. They also did
not pay the Zakat (state tax) which paid for the defense of the Muslim
state. They paid a substitute tax, which was approximately the same,
and they shared in all of the benefits of the state (today the
Republicans would call them “socialist” because the state assured the
health, welfare and education of all of its citizens.)

The Quran, and Islamic Law
forbid offensive wars,
and allow only
defensive wars. Self-defense is a natural right. From its beginning
Islam and Muslims have been under attack starting with the pagan
Qureish and the Jews of Medina, then the Christian Emperor of Rome and
the Persian fire worshippers. Later it was Crusaders, and now the
Zionists and the Christians who defame and bring war to Muslim lands.

For centuries Jews, Christians, and other faiths were protected. Jews
and Christians sought sanctuary in Muslim countries (Iraq, Syria,
Palestine) from the Inquisition. They were received by Muslim rulers
and lived peacefully for centuries with Muslims until the UN created
Israel displacing Palestinians.

The oldest Christian churches and
Jewish synagogues still operate and
serve in Muslim majority countries. They thrived there while those
countries lived under shariah law. Their ancient churches and
monasteries still operate despite the despotic regimes now prevalent.

No Muslim country has followed shariah in two hundred years. The
imperial powers eliminated it along with Islamic education, politics,
trade, and finance systems. So today Saudi Arabia, Afghanistan, Iraq,
Iran and other “Muslim” countries in their institutions and law ignore
the teaching and example of the prophet Mohammed, s.a.w., the Shariah,
just as you ignore the teaching and example of the prophet Jesus Christ

I pray that God guide you to the truth, and that the example of Jesus
with his love for all, the sinner and the saint, soften your heart and
lead you to see, and I pray respect the truth, and quit propaganda.

Jesus’ teachings

Invoking Jesus to defend Islam and attack
disbelievers is a common tactic to which I attach the label: AssWholliness.
My supposed remoteness from the teachings of Jesus is argumentum
adhominem; an irrelevant logical fallacy. The facts and opinions I
utter & publish stand on their own merit, not on my own lack of
divine perfection.

What is the relevance of Christ’s universal
benevolence to a blog post about a codification of Shari’ah?
None, of course; a Muslim is trying to defend the indefensible by
attacking me with my own savior.  There is one little problem: the
attack has no merit; its malignant malarkey.


Search the Qur’an for “Allah loves”. I tried the
Hilali & Khan translation and found seven surahs containing
matches. At the risk of boring you to tears,. I present the relevant
ayat, with highlighting to bring out important points and links so that
you can check the context. In a few important cases, I include the
context here. .

  • 2:195.
    And spend in the Cause of Allâh (i.e. Jihâd of all kinds, etc.) and do not throw yourselves into
    destruction (by not spending your wealth in the Cause of Allâh)
    and do good. Truly, Allâh loves Al-Muhsinûn(the good-doers).
  • 2:222. They ask you concerning menstruation. Say:
    that is an Adha (a harmful thing for a husband to have a sexual
    intercourse with his wife while she is having her menses), therefore
    keep away from women during menses and go not unto them till they have
    purified (from menses and have taken a bath). And when they have
    purified themselves, then go in unto them as Allâh has ordained for you
    (go in unto them in any manner as long as it is in their vagina).
    Truly, Allâh loves those who turn unto Him in repentance and loves those who purify themselves
    (by taking a bath and cleaning and washing thoroughly their private
    parts, bodies, for their prayers, etc.).
  • 3:31. Say (O Muhammad  to mankind): “If you
    (really) love Allâh then follow me (i.e. accept Islâmic Monotheism,
    follow the Qur’ân and the Sunnah), Allâh will love you and forgive you
    of your sins
    . And Allâh is Oft-Forgiving, Most Merciful.”
  • 3:76. Yes, whoever
    fulfils his pledge
    and fears Allâh much; verily, then Allâh loves those who are
    (the pious – see V.2:2).
  • 3:134. Those who spend [in Allâh’s Cause
    deeds of charity, alms, etc.] in prosperity and in adversity, who
    repress anger, and who pardon men; verily, Allâh loves Al-Muhsinûn (the

  • 3:147. And they said nothing but: “Our Lord!
    Forgive us our sins and our transgressions (in keeping our duties to
    You), establish our feet firmly, and give us victory over the
    disbelieving folk.

    3:148. So Allâh gave them the reward of this world, and the excellent
    reward of the Hereafter. And Allâh
    loves Al-Muhsinûn (the good­doers
    – see the footnote of V.3:134).

  • 3:156. O you who believe! Be not like those who disbelieve (hypocrites) and
    who say to their brethren when they travel through the earth or go out
    to fight: “If they had stayed
    with us, they would not have died or been killed,
    ” so that Allâh
    may make it a cause of regret in their hearts. It is Allâh that gives
    life and causes death. And Allâh is All­Seer of what you do.

    3:157. And if
    you are killed or die in the Way of Allâh, forgiveness and mercy from
    are far better than all that they amass (of worldly
    wealths, etc.).

    3:158. And whether you die, or
    are killed
    , verily, unto Allâh you shall be gathered.

    3:159. And by the Mercy of Allâh, you dealt with them gently. And had
    you been severe and harsh­hearted, they would have broken away from
    about you; so pass over (their faults), and ask (Allâh’s) Forgiveness
    for them; and consult them in the affairs. Then when you have taken a
    decision, put your trust in Allâh, certainly, Allâh loves those who put their trust
    (in Him).

  • 5:13. So because
    of their breach of their covenant, We cursed them
    , and made
    their hearts grow hard. They change the words from their (right) places
    and have abandoned a good part of the Message that was sent to them.
    And you will not cease to discover deceit in them, except a few of
    them. But forgive them, and overlook (their misdeeds). Verily, Allâh loves Al­Muhsinûn
    (good­doers – see V.2:112).
  • 5:42. (They like to) listen to falsehood, to
    devour anything forbidden. So if they come to you (O Muhammad ), either
    judge between them, or turn away from them. If you turn away from them, they
    cannot hurt you in the least.
    And if you judge, judge with
    justice between them. Verily, Allâh
    loves those who act justly.
  • 5:54. O you who believe! Whoever from among you turns back
    from his religion
    (Islâm), Allâh will bring a people whom He
    will love
    and they will love Him; humble towards the believers, stern towards the disbelievers,
    fighting in the Way of Allâh,
    and never afraid of the blame of
    the blamers. That is the Grace of Allâh which He bestows on whom He
    wills. And Allâh is All­Sufficient for His creatures’ needs,
  • 5:93. Those who believe and do righteous good deeds,
    there is no sin on them for what they ate (in the past), if they fear
    Allâh (by keeping away from His forbidden things), and believe and do righteous good deeds, and
    again fear Allâh and believe, and once again fear Allâh and do good
    deeds with Ihsân (perfection). And Allâh loves the good­doers.
  • 9:3. And a declaration from Allâh and His
    Messenger to mankind on the greatest day (the 10th of Dhul-Hijjah – the
    12th month of Islâmic calendar) that Allâh is free from (all)
    obligations to the Mushrikûn (see V.2:105) and so is His Messenger. So
    if you (Mushrikûn) repent, it is better for you, but if you turn away,
    then know that you cannot escape (from the Punishment of) Allâh. And
    give tidings (O Muhammad ) of a
    painful torment to those who disbelieve.

    9:4. Except those of the Mushrikûn with whom you
    have a treaty, and who have not subsequently failed you in aught, nor
    have supported anyone against you. So fulfill their treaty to them to
    the end of their term. Surely Allâh
    loves Al- Mattaqûn
    (the pious – see V.2:2).

    9:5. Then when the Sacred Months (the Ist, 7th, 11th, and 12th months
    of the Islâmic calendar) have passed, then kill the Mushrikûn (see
    V.2:105) wherever you find them, and capture them and besiege them, and
    prepare for them each and every ambush
    . But if they repent and
    perform As-Salât (Iqâmat-as-Salât), and give Zakât, then leave their
    way free. Verily, Allâh is
    Oft-Forgiving, Most Merciful

  • 9:7. How can there be a covenant with Allâh and
    with His Messenger for the Mushrikûn (polytheists, idolaters, pagans,
    disbelievers in the Oneness of Allâh) except those with whom you made a
    covenant near Al-Masjid-al-Harâm (at Makkah)? So long, as they are true
    to you, stand you true to them. Verily, Allâh loves Al-Muttaqûn (the
    pious – see V.2:2).
  • 9:108. Never stand you therein. Verily, the mosque
    whose foundation was laid from the first day on piety is more worthy
    that you stand therein (to pray). In it are men who love to clean and
    to purify themselves. And Allâh
    loves those who make themselves clean and pure
    (i.e. who clean their private parts
    with dust
    [i.e. to be considered as soap) and water from urine
    and stools, after answering the call of nature].
  • 49:9. And if two parties or groups among the
    believers fall to fighting, then make peace between them both, but if
    one of them rebels against the other, then fight you (all) against the
    one that which rebels till it complies with the Command of Allâh; then
    if it complies, then make reconciliation between them justly, and be
    equitable. Verily! Allâh loves
    those who are equitable
  • 60:8. Allâh does not forbid you to deal justly and
    kindly with those who fought not against you on account of religion and
    did not drive you out of your homes. Verily, Allâh loves those who deal with

    Cause in rows (ranks) as if they were a solid structure

Allah loves those who do not throw themselves to
destruction by shirking jihad. How sweet.  Allah will love you if you emulate Moe… a murdering
lecher, pirate & pedophile.  Whoever fulfills his pledge is a
reference to the Pledge of Ar-Ridwan: to fight to the death for
Islam.  Allah loves those who spend in his cause; a reference to
jihad with their lives and their wealth.  Allah forgives those who
get killed in his wars.  Allah loves those who wipe their butts
with sand.  Where is  Allah’s love for mankind in general;
for sinners?  3:16 For God so loved the world, that he gave his
only begotten Son, that whosoever believeth in him should not perish,
but have everlasting life.    (King James Bible, John)

Islamic love and charity are for Muslims only. Muslims are commanded to shun their fathers and
brothers if they are not Muslims.

When you invoke Jesus Christ to condemn the facts I
utter and publish,. you have a big problem, because I do not pull my
punches.  Allah denies Christ’s patrimony, deity, crucifixion,
death & resurrection.   Moe’s prophesies depict Jesus as
less worthy than himself and a genocidal warlord who will return to
kill the remaining Jews & Christians.  I refer doubters &

classed by Allah as disbelievers. Allah commands Muslims to wage war against them

Zakat given to dhimma

The law codified in Reliance explicitly forbids

hS.14 The fourth category is those whose hearts

are to be reconciled. If they
are non-Muslims, they

are not given zakat, but
if Muslims, then they may

be given it (0: so that their certainty may increase,

or if they are recent converts to Islam and are

alienated from their kin).

(1) the chief personages of a people (0: with

weak Islamic intentions) whose Islam may be

expected to improve, or whose peers may be

expected to enter Islam;

(2) or the heads of a people who collect zakat

for us from Muslims living near them who refuse

to pay it, or who fight an enemy for us at considerable

expense and trouble to themselves.

Nobody became a Dhimmi without first being conquered
or intimidated by Muslims.  Islam is a protection racket. Dhimmis
paid Moe to protect themselves from him, and in one case the jizya was
one half of their annual crop yield.  I direct the attention of
doubters & dissenters to this hadith which describes Moe’s orders to his
commanders in the field.   ” If
they refuse to accept Islam, demand from them the Jizya. If they agree
to pay, accept it from them and hold off your hands. If they refuse to
pay the tax, seek Allah’s help and fight them..

Quran, and Islamic Law forbid offensive wars

There is no al-Taqiyya more offensive that this
direct deception.  Offensive conquest is commanded, not
forbidden!  The two principle jihad imperatives make no mention of
being defensive or in response to attack. Read them and their tafsirs;
bring forth facts with which to prove me wrong.

  • 8:38. Say to those who
    have disbelieved,
    if they cease (from disbelief) their past will
    be forgiven. But if they
    (thereto), then
    the examples of those (punished) before them have already preceded

    (as a warning).

    8:39. And fight
    them until
    there is no
    more Fitnah
    (disbelief and polytheism: i.e. worshipping others
    besides Allâh) and the religion
    (worship) will all be for Allâh Alone
    the whole of the world ]. But if they cease (worshipping others besides
    Allâh), then certainly, Allâh is All-Seer of what they do.

      • (And fight them
        until there is no more Fitnah
        …).” Ibn `Umar said, “We did
        that during the time of the Messenger of Allah, when Islam was weak and
        the man would be tried in religion, either tormented to death or being
        imprisoned. When Islam became stronger and widespread, there was no
        more Fitnah.” When the man realized that Ibn `Umar would not agree to
        what he is saying, he asked him, “What do you say about `Ali and
        `Uthman” Ibn `Umar replied, “What do I say about `Ali and `Uthman! As
        for `Uthman, Allah has forgiven him, but you hate that Allah forgives
        him. As for `Ali, he is the cousin of the Messenger of Allah and his
        son-in-law,” and he pointed with his hand saying, “And this is his
        house over there.” Sa`id bin Jubayr said, “Ibn `Umar came to us and
        was asked, “What do you say
        about fighting during Fitnah” Ibn `Umar said, “Do you know what Fitnah
        refers to Muhammad was fighting against the idolators, and at that
        time, attending (or residing with) the idolators was a Fitnah (trial in
        religion). It is nothing like what you are doing, fighting to gain
        All these narrations were collected by Al-Bukhari,
        may Allah the Exalted grant him His mercy. Ad-Dahhak reported that Ibn
        `Abbas said about the Ayah,

      The caliph fights all
      other peoples until they become Muslim

      (O: because they are not a people with a Book, nor honored as such, and
      are not permitted to settle with paying the poll tax (jizya) ) (n:
      though according to the Hanafi school, peoples of all other religions,

      the Islamic state if they either become Muslim or agree to pay the poll

  • 9:29. Fight
    against those who
    (1) believe
    not in Allâh
    (2) nor in the Last Day, (3) nor forbid that which has been forbidden
    by Allâh and His Messenger (4) and those who acknowledge not the
    religion of truth (i.e. Islâm) among
    the people of the Scripture
    (Jews and Christians), until they pay the Jizyah with
    willing submission, and feel themselves subdued. 
    • The Order to fight People of the Scriptures until They
      give the Jizyah
      • This honorable Ayah was revealed with the order to fight the
        People of the Book, after the pagans were defeated, the people entered
        Allah’s religion in large numbers, and the Arabian Peninsula was
        secured under the Muslims’ control. Allah commanded His Messenger to
        fight the People of the Scriptures, Jews and Christians, on the ninth
        year of Hijrah, and he prepared his army to fight the Romans and called
        the people to Jihad announcing his intent and destination.
    • O9.8: The Objectives of Jihad

      The caliph (o25) makes
      war upon Jews, Christians, and Zoroastrians

      (N: provided he has first invited them to enter Islam in faith and
      practice, and if they will not, then invited them to enter the social
      order of Islam by paying the non-Muslim poll tax (jizya, def: o11.4)
      -which is the significance of their paying it, not the money
      itself-while remaining in their ancestral religions) (O:
      and the war continues) until they become Muslim or else pay the
      non-Muslim poll tax (O: in accordance with the word of Allah Most High,

      Fight those who do not believe
      in Allah and the Last Day and who forbid not what Allah and His
      messenger have forbidden-who do not practice the religion of truth,
      being of those who have been given the Book-until they pay the poll tax
      out of hand and are humbled”
      (Koran 9.29),

      the time and place for which is before the final descent of Jesus (upon
      whom be peace).  After his final coming, nothing but Islam will be
      accepted from them, for taking the poll tax is only effective until
      Jesus’ descent (upon him and our Prophet be peace), which is the
      divinely revealed law of Muhammad. The coming of Jesus does not entail
      a separate divinely revealed law, for he will rule by the law of
      Muhammad. As for the Prophet’s saying (Allah bless him and give him

      “I am the last, there will be no prophet after me,”

      this does not contradict the final coming of Jesus (upon whom be
      peace), since he will not rule according to the Evangel, but as a
      follower of our Prophet (Allah bless him and give him peace) ).

Allah said “fight them… until”. Not those who
attack you; them.
The smug, smarmy, self-righteous Muslim, convinced of the superiority
of his demon and himself, while substituting his anus for the brain
Allah has eaten, supposes us to be so stupid, ignorant and indolent
that we can neither discover nor comprehend objective factual
reality.  There is no greater arrogance than that which asserts
that offensive conquest is harram!

Defensive jihad is covered in Surahs Surah Al-Hajj 22:39
and Al-Baqarah 2:190.
In Reliance, O9.0 defines jihad as war against non-Muslims. O9.1
defines the communal obligation. Offensive jihad is fard kifaya, only
defensive jihad is fard ayn.  The minimum requirement is one
ghazwat in every year, without which, if it were possible, all who know
of it are sinners.

  • O9.1: The Obligatory Character of Jihad

    is a communal obligation
    (def: c3.2).  When enough people perform it to
    successfully accomplish it, it is no longer obligatory upon others

    (O: the evidence for which is the Prophet’s saying (Allah bless him and
    give him peace),

    “He who provides the equipment for a
    soldier in jihad has himself performed jihad,”

    and Allah Most High having said:

    “Those of the believers who are unhurt but
    sit behind are not equal to those who fight in Allah’s path with their
    property and lives. Allah has preferred those who fight with their
    property and lives a whole degree above those who sit behind. And to
    each, Allah has promised great good” (Koran 4:95).

    none of those concerned perform jihad, and it does not happen at all,
    then everyone who is aware that it is obligatory is guilty of sin, if
    there was a possibility of having performed it.
    In the time of
    the Prophet (Allah bless him and give him peace) jihad was a communal
    obligation after his emigration (hijra) to Medina. As for subsequent
    times, there are two possible
    states in respect to non-Muslims

    The first is when they are in their own
    countries, in which case jihad (def: o9.8) is a communal obligation
    and this is what our author is speaking of when he says, “Jihad is a
    communal obligation,” meaning
    upon the Muslims each year

    The second state is when non-Muslims invade a Muslim
    country or near to one, in which case jihad is personally obligatory

    (def: c3.2) upon the inhabitants

Exactly what part of that does Anonymous not
comprehend?  Perhaps Al-Shafi’i can clarify it for him.

Shariah4America, But Not Today

When I viewed two videos of Stand Up For America’s counter demonstration, I discovered that Andy Choudary did not show up in front of the White House. I saw a small group of Christians and about half as many Muslims with one of the latter caterwauling in Arabic.  Now, through the news feed at Facebook, I discovered that the grand demonstration has been postponed indefinitely.

Choudary blames ‘media distortion’ of his message for the delay. Then he launches into a long screed, condemning our nation and way of life, offering to substitute a combination of Islam & Socialism as the solution.

Choderhead declares that Shari’ah is about “enjoining good” & “forbidding wrong”.  Who can argue with that concept?  The problem is  is in the definition of terms.  In their minds, anything that ain’t Islam is wrong.

The Islamic Punishment for Paedophiles

Probably one of the most wicked and disturbing acts conceivable to the human mind, paedophilia ranks high on the list of crimes worthy of severe punishment – not so in America, it seems.

Unfortunately, with a US constitution so dogged in the false creed that is freedom, it appears that even paedophilia can find solace in a society that virulently promotes perversion and indecency. Organisations such as NAMBLA (North American Man/Boy Love Association), which seek to legalise this vile act demonstrate clearly the severity of the situation at hand as well as the need America has for a divine solution.

The Islamic constitution or Shari’ah, mete out rules and regulations sourced directly from divine revelation and as such compliment the natural disposition of human beings perfectly; indeed those who have not been polluted by the false traditions and customs of their society will undoubtedly find the Shari’ah very agreeable, and it is because of this very reason that we find Islam is the fastest growing religion on earth.

The Islamic punishment for paedophilia not only eradicates this savage behaviour from society, but also provides a feeling that real justice has been delivered, particularly for close relatives of innocent children cruelly subjected to this criminal act.

So what is the punishment, you may ask? If an individual is found guilty of paedophilia in Islam, then he or she will be impaled on a sharp spike, known in Arabic as the Kashabah, and left until death overcomes them; the Kashabah, is also typically placed on public display as a vivid warning to all those wishing to engage in this loathsome act.

As part of the Shariah4America campaign, we propose that the Washington Monument be used as a fitting mechanism to execute this very just punishment.

So ask yourself, would you rather a paedophile receive free healthcare, accommodation and food in California’s Coalinga Mental Hospital or does the Islamic verdict on the matter sound much more reasonable?

There is something you need to know; something few others will reveal to you. Because I do not give a damn who is offended, I will reveal it, making the fatal facts of Islam easy for the incredulous reader to verify.   We turn first to Allah’s word, with critical phrases highlighted for clarity.  This is the Hilali & Khan translation, which includes parenthetical expressions supplied from tafsir by the translators.

65:4. And those of your women as have passed the age of monthly courses, for them the ‘Iddah (prescribed period), if you have doubts (about their periods), is three months, and for those who have no courses [(i.e. they are still immature) their ‘Iddah (prescribed period) is three months likewise, except in case of death] . And for those who are pregnant (whether they are divorced or their husbands are dead), their ‘Iddah (prescribed period) is until they deliver (their burdens), and whosoever fears Allâh and keeps his duty to Him, He will make his matter easy for him.
[1] (V.65:1) Narrated ‘Abdullâh bin ‘Umar رضي الله عنهما that he had divorced his wife while she was menstruating during the lifetime of Allâh’s Messenger صلى الله عليه وسلم . ‘Umar bin Al-Khattâb رضي الله عنه asked Allâh’s Messenger صلى الله عليه وسلم about that. Allâh’s Messenger صلى الله عليه وسلم said, “Order him (your son) to take her back and keep her till she is clean from her menses and then to wait till she gets her next period and becomes clean again, whereupon, if he wishes to keep her, he can do so, and if he wishes to divorce her he can divorce her before having sexual intercourse with her; and that is the ‘Iddah (prescribed period) which Allâh has fixed for the women meant to be divorced.” (Sahih Al Bukhari, Vol.7, Hadîth No.178).

Of course, that translation is widely considered to be polemical and non-standard, so lets consult another; that of Aisha Bewley, a convert to Islam.

In the case of those of your wives who are past the age of menstruation, if you have any doubt, their ‘idda should be three months, and that also applies to those who have not yet menstruated. The time for women who are pregnant is when they give birth. Whoever has taqwa of Allah – He will make matters easy for him.

Why does Allah make provision for a post divorce waiting period for pre-pubescent girls?   Its Shari’ah, stupid!  What Moe said while speaking for Allah and what he did is the law.  Lets consult the all purpose handbook of Shari’ah: Reliance of the Traveller, Book N (Divorce)

Chapter N9.0: A Woman’s Postmarital Waiting Period (`Idda)

(O: Meaning the period in which a woman waits (N: before she may remarry) to verify that she is not pregnant, or out of mourning for her deceased husband.)

(N: If the waiting period finishes after a once-or twice-pronounced divorce, the wife is free to marry another man or to remarry the husband with a new contract-returning to the latter with the number of times left (one or two) needed to enact a threefold, finalized divorce (dis: n7.7); while if the waiting period of a less-than-thrice-pronounced divorce has not yet expired, the husband may take her back (def: n7) without a new contract.)

(n: The husband’s obligation to support her during the waiting period is discussed at m11.10 above.)


There is no waiting period for a woman divorced before having had sexual intercourse with her husband.


A waiting period is obligatory for a woman divorced after intercourse, whether the husband and wife are prepubescent, have reached puberty, or one has and the other has not.

Intercourse means copulation (def: n7.7).  If the husband was alone with her but did not copulate with her, and then divorced her, there is no waiting period.

Islamic law anticipates the consummation of marriage with pre-pubescent girls!  Is that not pedophilia?  Lets delve a little deeper, this time into Book M (Marriage).

M3.13: Guardians Who May Marry a Virgin to a Man Without Her Consent

Guardians are of two types, those who may compel their female charges to marry someone, and those who may not.

-1- The only guardians who may compel their charge to marry are a virgin bride’s father or father’s father, compel meaning to marry her to a suitable match (def: m4) without her consent.

-2- Those who may not compel her are not entitled to marry her to someone unless she accepts and gives her permission.

Whenever the bride is a virgin, the father or father’s father may marry her to someone without her permission, though it is recommended to ask her permission if she has reached puberty. A virgin’s silence is considered as permission.

As for the nonvirgin of sound mind, no one may marry her to another after she has reached puberty without her express permission, no matter whether the guardian is the father, father’s father, or someone else.

A Muslim  can compel his virgin daughter to marry whomever he chooses, but if she has reached puberty, it is recommended to ask her assent!  Let that sink in for a moment. That is an integral part of the Islamic Law Muslims want to impose upon us.

Who the Hell would marry a pre-pubescent girl?   Who indeed!

Sahih Bukhari volume 7, Book 62, Number 64:

Narrated ‘Aisha:

that the Prophet married her when she was six years old and he consummated his marriage when she was nine years old, and then she remained with him for nine years (i.e., till his death).

That hadith comes from the most authentic of the six canonical collections.  It is mutawir, that is, backed up by other narrations.

Marrying little girls is sunnah, and they accuse us of pedophilia!  The hypocrisy stinks to high heaven.

White House Shari’ah Rally: What Do They Want?

I learned from a Daily Mail article that three infamous British Muslims have been asked to address a pro Shari’ah rally at the White House March 3, 2011. The event is sponsored by the International Institute of Islamic Thought.   If we had rational and patriotic leaders in power, Anjem Choudary, Abu Izzadeen and Sayful Islam would be denied visas.

The theme of the rally is supposed to be exhortation to rise up and impose Shari’ah on America. Literally the “path to life giving waters”, Shari’ah is a codification of the laws laid down in the Qur’an & hadith.

The Sunnis comprise the majority of Muslims and the Shafi’ite school of jurisprudence is the most widely accepted of the Sunni schools. Its handbook of fiqh is Reliance of the Traveller and Guide to the Faithful.

I have included images from a pdf file scanned from Reliance of the Traveller. Click them to view full sized images. Lest you doubt the authenticity of the text, I included two certifications of authenticity, from al-Azhar & IIIT.

Reliance is divided into topical books. Book o treats of “Justice”; chapter 9 treats the law of jihad, beginning with a definition:

09.0 JIHAD
(0: Jihad means to war against non-Muslims,
and is etymologically derived from the word
mujahada, signifying warfare to establish the

The text cites several verses of the Qur’an and hadith to back that up.  o9.1 discusses the communal obligation of waging war against infidels, which is “meaning upon the Muslims each year”  Islamic law requires a minimum of one military expedition against infidels in every year.

O9.8 reveals the practical application of that communal obligation.

o9.8 Thc caliph (025) makes war upon Jews,
Christians, and Zoroastrians (N: provided he has
first invited them to enter Islam in faith and practice,
and if they will not, then invited them to
enter the social order of Islam by paying the nonMuslim
poll tax (jizya, def: 01 L4)-which is the
significance of their paying it, not the money
itself-while remaining in their ancestral religions)
(0: and the war continues) until they
become Muslim or else pay the non-Muslim poll
tax (0: in accordance with the word of Allah Most

The text continues with the scriptural basis of the ruling, which is 9:29.  Note the similarity of expression used by J.M. Rodwell.

Make war upon such of those to whom the Scriptures have been given as believe not in God, or in the last day, and who forbid not that which God and His Apostle have forbidden, and who profess not the profession of the truth, until they pay tribute out of hand, and they be humbled.

O9.9 follows up with warfare against pagans.

09.9 The caliph fights all other peoples until
they become Muslim (0: because they are not a
people with a Book, nor honored as such, and are
not permited to settle with paying the poll tax…

Imam Faisal Abdul Rauf and other advocates of Shari’ah won’t tell you about those provisions, why not?

There are important considerations other than violence. The concept of equality is one of them.  Consider what chapter 24 says about testimony.

024.2 Legal testimony is only acceptable from a
witness who:
(a) is free;
(b) is fully legally responsible (mukallaf, def:
c8.1) (0: as testimony is not accepted from a child
or insane person, even when the child’s testimony
regards injuries among ehildren that oeeurred at
(e) is able to speak;
(d) is mentally awake;
(e) is religious (0: meaning upright (024.4)
(A: and Muslim), for Allah Most High says,
“Let those of rectitude among you testify”
(Koran 65:2),
and unbelief is the vilest form of corruption, as
goes without saying);

If you ain’t Muslim, you can’t be a witness!  Let that sink in for a moment. Read it again.  What do you think about Shari’ah now?  The testimony of a man is worth that of two women.

024.7 The testimony of the following is legally
acceptable when it concerns cases involving property,
or transactions dealing with property, such
as sales:
(1) two men;
(2) two women and a man;
(3) or a male witness together with the oath
of the plaintiff.

Why is the feminist movement silent about this?

In England and some American states, there is pressure for application of Shari’ah to domestic matters; family disputes.  The laws concerning marriage are laid out in book m.  I will raise one quote from that book, containing a concept which will cause any rational and compassionate person to reject Shari’ah.

Divorce is one of the more important family law matters. Under Shari’ah, a husband need only declare divorce three times to give it legal effect.

n1.3 The person conducting the divorce may
effect it himself or commission another (def:
k17.5-6) to do so, even if the person commissioned
is a woman.
The person commissioned may effect the
divorce at any time (0: provided the one who
commissions him does not cancel the commission
before the divorce takes place (dis: k17.16»,
though when a husband tells his wife. “Divorce
yourself,” then if she immediately says, “I divorce
myself,” she is divorced, but if she delays, she is
not divorced unless the husband has said, “Divorce
yourself whenever you wish.”

n2.1 A free man has three pronouncements of
divorce (0: because of the word of Allah Most
“Divorce is two times, then retain with kindness
or graciously release” (Koran 2:229),
and when the Prophet (Allah bless him and give
him peace) was asked about the third time, he
“It is Allah’s having said, ‘or graciously
release’ “).

Reliance is not the only handbook of Islamic law, though it is the most popular. Others are generally less detailed in some matters. Al-Hedaya is not as easy to read but it explains the differences between Shafi’ite and Hanifi fiqh.

For the Maliki fiqh on jihad, turn to chapter 30 of Risala, which offers less detail than Reliance.  The Hanifi fiqh of jihad is in  al-Hedaya, Vol. II, Book IX, Chapter 1.

The fiqh of wudu & prayer tends to be arcane, nonsensical and harmless to us. But the Islamic law regarding war is totally unacceptable, as is the inequality of women and religious minorities.  The concepts of arbitrary divorce & forced marriage are so repugnant as to compel vigorous objection to imposition of Shari’ah.

Let us therefore rise up as one with a loud voice shouting HELL NO!!! to those who demand imposition of Islamic law.  Let us support the state legislation designed to ban it and make demands for national legislation to prevent the imposition of Shari’ah in the federal courts.

The language barrier  is  obviously at play in this update.  If I interpret it correctly, a stay had been issued in conjunction with an appeal to the High Court but the Judge pressed forward regardless.

It becomes clear that there is little or no justice for Christians in Pakistan.  The section of Reliance of the Traveller which explains  who is qualified to testify in court exposes the horrific truth. Note the words which I emphasized.

Dear group members.

21st August 2010 was the hearing of Hector Aleem, so here is the update about the hearing. First of all our lawyer asked the judge for the stay, because the High Court has given the stay for the quashment of the case and advised the lower court not to proceed until the High Court allows the lower court but as the judge of the lower court is very discriminative, he was not ready to give the stay even after the order of the High Court but after our lawyer gave some legal points and told him to wait until the judgment of the High Court he agreed not to proceed but the Mullahs and the Lawyer of the plaintiff pressurized him to proceed other wise they will protest and will destroy the court, the judge than started the proceeding. All the witnesses were available and our lawyer had to question them but the Investigation officer of Hector’s case was not available, so the judge has ordered the IO (investigation officer) to come on the next hearing. During the argument of both lawyers (our and plaintiff’s) they both argued so harshly and were about to had a physical fight. But the judge ordered both of them to calm down. And gave the next date of hearing. This all situation tells us that our lawyer is quiet brave and is ready to face any situation.
