Defamation of Religions 2010


The General Assembly vote on the Defamation of Religions resolution [Word Document] was not unexpected, nor was the slight decline in support for the resolution.

The resolution has no enforcement mechanism, it is an exhortation, not law.  Unfortunately, it affords undeserved legitimacy to national blasphemy laws which are used to persecute minorities in Islamic dictatorships.

To make matters worse, there is a parallel process whose outcome will be a binding protocol to ICERD which will be legally enforcible. The information I have gathered is reported in these blog posts:

Human rights belong to humans, not to institutions.  There is no human right to be shielded from criticism of evil actions or intentions which are propagated in the name of religion.

Shari’ah, particularly Reliance of the Traveller, Book O, Chapter 8, which lists 20 ‘acts’ which ‘entail apostasy’. In short, any negative statement about Islam, Moe, Allah or the Qur’an is punishable by execution [o8.1-8.2]. For the law’s applicability to non-Muslims, see o11.10 & o9.14.

While I vociferously object to the entire resolution & its antecedents included by reference, there is one provision which stands alone as a perfect reason to reject the entire concept of “defamation of Islam”.

7. Expresses deep concern, in this respect, that Islam is frequently and

wrongly associated with human rights violations and terrorism;

I have frequently quoted the relevant ayat & ahadith in numerous posts. I will link them here, and let those who are unfamiliar with them follow the links while the rest of us advance to the Sira.

Allah said that he would “cast terror” but “Islam is frequently and wrongly associated with human rights violations and terrorism;” Allah said that he cast terror, resulting in death, captivity, dispossession & destruction, but “Islam is frequently and wrongly associated with human rights violations and terrorism;”.

Moe said that he was made “victorious with terror” but “Islam is frequently and wrongly associated with human rights violations and terrorism;” For those who don’t have a clue yet, I provide quotes from the oldest extant biography of Islam’s Profit: Guillaume’s translation of Ibn Ishaq’s Sirat Rasul Allah.

These quotes come from devoted followers, not from enemies.

Ishaq:322 “Allah said concerning the pebbles thrown by the Apostle, ‘I threw them not you. Your
tossing them would have had no effect without My help. But working together, We
terrorized the enemy and put them to flight.”

Ishaq:395 “Muslims, if you listen to the unbelievers you will retreat from the enemy and become losers. Ask Allah

“We carried Ka’b’s head and brought it to Muhammad during the night. We

praised Allah that the poet had been assassinated and complimented us on the
good work we had done in Allah’s Cause. Our attack upon Allah’s enemy cast
terror among the Jews, and there was no Jew in Medina who did not fear for
his life.'”

given the most powerful words. Booty was made lawful for me. I was given the power to intercede. These
five privileges were awarded to no prophet before me.'”

Take a closer look at that quote from page 326. Moe was given five privileges by Allah, privileges not given to any Prophet. These are privileges given by Allah to his final messenger, the founder of Islam:

  • taking booty
    • ransoming prisoners
  • victory with terror
  • entire earth is his prayer ground
  • most powerful words
  • booty made lawful
  • power to intercede

Winning with terror is a special privilege from Allah. Got a clue yet?  If this blasphemy does not cause you to curse, go out and hang yourself, you are a waste of life.

Ishaq 523 When the apostle had finished with Khaybar, God struck terror to the
hearts of the men of Fadak when they heard what the apostle had done to
the men of Khaybar.

Ishaq 461
According to what al-Zuhri told me, at the time of the noon prayers 

Gabriel came to the apostle wearing an embroidered turban and riding on a mule with a saddle covered with a piece of brocade. He asked the apostle if he had abandoned fighting, and when he said that he had he said that the angels had not yet laid aside their arms and that he had just come from pursuing the enemy. ‘God commands you, Muhammad, to go to B.   Qurayza. I am about to go to them to shake their stronghold.’…

The apostle passed by a number of his companions in al-Saurayn before he got to B. Qurayza and asked if anyone had passed them. They replied that Dihya b. Khalifa al-Kalbi had passed upon a white mule with a saddle covered with a piece of brocade. He said, That was Gabriel who has been sent to B. Qurayza to shake their castles and strike terror to their hearts.’

Which one do you believe?

How is Islam associated with terrorism?  Who made that association??  What is wrong with it???  Do people have a right to live unmolested, without invasion, conquest & enslavement or not?  Does Islam violate that right?

The entire premise of the resolution combating defamation of religions is a lie.  Human Rights First reveals the vote: 79,67,40.  How in Hell could 79 nations vote in favor of that travesty of justice and 40 abstain from voting against it?  There are 57 Islamic nations, 62 are either deceived, intimidated or sucking Islam’s oil & money teats.

Lovers of life, liberty & justice are in the minority. The aggressors and their allies rule the UN. We are out voted. These annual resolutions will continue to pass in the HRC & GA every year, and the protocol to ICERD will eventually be written, voted on and ratified unless we rise up and raise Hell.

We have only one recourse: to counter attack by exposing Islamic doctrines & practices to the eyes of the world.  We must make the campaign to impose Shari’ah too painful to pursue.

Three international human rights covenants contain provisions which require that Islam be proscribed by law. Nobody will enforce them.  Our task is to disrespectfully demand enforcement of those provisions.  The evidence is outlined in the International Qur’an Petition.  What other defense do we have? Elimination of Racism and Related Intolerance


The sixty-fourth session Third Committee Agenda item 67 (a) Elimination of racism, racial discrimination, xenophobia and related intolerance A/C.3/64/L.53. echoes certain of its predecessors.   After the customary bs boilerplate& arcane references to external documents, they get down to brass tacks.[Emphasis added, spelling original.]

15. Reaffirms also that, as underlined in paragraph 13 of the outcome document of the Durban Review Conference, any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law, that the dissemination of ideas based on racial superiority,  hatred, acts of violence or incitement to such acts shall be declared offences punishable by law, and that these prohibitions are consistent with freedom of opinion and expression;

13. Reaffirms that any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law; reaffirms further that all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts shall be declared offence punishable by law, in accordance with the international obligations of States and that these prohibitions are consistent with freedom of opinion and expression; [http://www.un.org/durbanreview2009/pdf/Durban_Review_outcome_document_En.pdf]

16. Underlines at the same time the positive role that the exercise of the right to freedom of opinion and expression, as well as the full respect for the freedom to seek, receive and impart information, can play in combating racism, racial discrimination, xenophobia and related intolerance;

17. Encourages those States that have made reservations to article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination to give serious consideration to withdrawing such reservations as a matter of priority;

Article 4

States Parties condemn all propaganda and all organizations which are based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote racial hatred and discrimination in any form, and undertake to adopt immediate and positive measures designed to eradicate all incitement to, or acts of, such discrimination and, to this end, with due regard to the principles embodied in the Universal Declaration of Human Rights and the rights expressly set forth in article 5 of this Convention, inter alia:

(a) Shall declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;

(b) Shall declare illegal and prohibit organizations, and also organized and all other propaganda activities, which promote and incite racial discrimination, and shall recognize participation in such organizations or activities as an offence punishable by law;

(c) Shall not permit public authorities or public institutions, national or local, to promote or incite racial discrimination.

The United States of America does not regard the Convention as creating any obligation incompatible with the United States Constitution. It does not accept any obligation to enact measures under Article 4, which it views these as incompatible with freedom of expression, or under Articles 2, 3, and 5 with respect to private conduct. ¶15 quotes and cites ¶13 of the outcome document of the Durban Review Conference. In reading that text, recall the  report of the preliminary meeting, which equates criticism of Islam with racism: “anti-Semitism, Christianophobia, and Islamophobia as contemporary forms of racism”.

The terms therein referenced require clear definition.

  • advocacy of national, racial or religious hatred
  • constitutes incitement to discrimination, hostility or violence
  • ideas based on racial superiority,
    • hatred,
    • acts of violence or incitement to such acts

Those terms are broadly defined by the OIC and its factotum. Examine the Secretary General’s condemnation of Fitna.

“There is no justification for hate speech or incitement to violence,” Ban said in a statement. “The right of free expression is not at stake here.” [Emphasis added for clarity.]

A 17 minute documentary video which displays verses from the Qur’an, rabble rousing sermons by Muslim clerics and the results thereof is:

  • hate speech
  • incitement to violence.

By that standard, all negative exposure of Islamic doctrines & practices must be outlawed. We must not state the fact that Islamic scripture declared war on us, Islamic tradition makes it perpetual, and the outcome, as it relates to Jews is genocidal. How can we defend ourselves if we  are prohibited by law from revealing the identity, intentions, motivation & actions of the enemy which assails us?

¶16 is an Orwellian way of telling us that only expression that praises Islam and conceal its intentions and effects can be permitted. ¶17 is a demand that we yield our First Amendment right to free speech to Islam’s blasphemy law.

I invite all parties to carefully consider ICERD’s fourth article, which is reproduced above. The signatories condemn all propaganda and organizations based on ideas of racial superiority.  But  racial no longer applies only to skin color, it applies to religion since Durban II conflated them. Those nations which signed ICERD must condemn all propaganda and organizations based on ideas of religious superiority.   Of course, you don’t have a clue. I will give you one.

Sahih Bukhari Volume 6, Book 60, Number 80:

Narrated Abu Huraira:

The Verse:–“You (true Muslims) are the best of peoples ever raised up for mankind.” means, the best of peoples for the people, as you bring them with chains on their necks till they embrace Islam.

3:110 declares Muslims to be the best of peoples, clearly an expression of religious superiority.  As Muslims and their factotums define the term, that is racial superiority, which must be condemned.

Sub paragraph a compels signatories to proscribe by law:

  • all dissemination of ideas based on racial superiority or hatred
  • incitement to racial discrimination
  • all acts of violence or incitement to such acts

Recalling the conflation of race with religion, (a) requires the outlawing of the Qur’an because it is based on religious (racial) superiority and incites violence against people of other religions (races).

Sub paragraph b requires signatories to proscribe by law:

  • organizations which promote racial discrimination
  • all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin

Bearing in mind the conflation of race with religion, Islam must be proscribed by law because it declares war on pagans, Jews & Christians and discriminates against conquered Jews & Christians by imposing a special tax on them and placing them under extraordinary legal & social limitations which are specified in Islamic law. Doubters & dissenters should turn to Reliance of the Traveller O9.8,  O9.9 & O11.5.

Of course, ICERD specifies race, it does not specify religion. But ICERD is not the only applicable international human rights covenant.

ICCPR

Article 20

  1. Any propaganda for war shall be prohibited by law.
  2. Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law.

Who can deny the fact that Surah At-Taubah is propaganda for and advocacy of religious hatred and war?  It must be prohibited by law!  Unfortunately, it is Allah’s perfected, immutable word, incapable of reformation. Proscribing the practice & propagation of Islam is the only alternative.

CPPCG

Article 1

The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish.

Article 2

In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

Article 3

The following acts shall be punishable:

8:37. In order that Allâh may distinguish the wicked (disbelievers, polytheists and doers of evil deeds) from the good (believers of Islâmic Monotheism and doers of righteous deeds), and put the wicked (disbelievers, polytheists and doers of evil deeds) one on another, heap them together and cast them into Hell. Those! it is they who are the losers.

17:16. And when We decide to destroy a town (population), We (first) send a definite order (to obey Allâh and be righteous) to those among them [or We (first) increase in number those of its population] who are given the good things of this life. Then, they transgress therein, and thus the word (of torment) is justified against it (them). Then We destroy it with complete destruction.

17:17. And how many generations have We destroyed after Nûh (Noah)! And Sufficient is your Lord as an All-Knower and All-Beholder of the sins of His slaves.

Allah speaks of heaping disbelievers together and casting them into Hell in 8:37.  In 17:16, he brags about making complete destruction. In 17:17 he brags about destroying multiple generations. He is setting a pattern and precedent. Observe how he fleshes it out.

8:67. It is not for a Prophet that he should have prisoners of war (and free them with ransom) until he had made a great slaughter (among his enemies) in the land. You desire the good of this world (i.e. the money of ransom for freeing the captives), but Allâh desires (for you) the Hereafter. And Allâh is All-Mighty, All-Wise.

In 8:67, Allah sets great slaughter as the prerequisite for releasing captives for ransom, telling Moe that he must put slaughter ahead of profit. That tells us that Allah favors genocide.  This is confirmed in Surah Muhammad.

47:4. So, when you meet (in fight Jihâd in Allâh’s Cause), those who disbelieve smite at their necks till when you have killed and wounded many of them, then bind a bond firmly (on them, i.e. take them as captives). Thereafter (is the time) either for generosity (i.e. free them without ransom), or ransom (according to what benefits Islâm), until the war lays down its burden. Thus [you are ordered by Allâh to continue in carrying out Jihâd against the disbelievers till they embrace Islâm (i.e. are saved from the punishment in the Hell-fire) or at least come under your protection], but if it had been Allâh’s Will, He Himself could certainly have punished them (without you). But (He lets you fight), in order to test you, some with others. But those who are killed in the Way of Allâh, He will never let their deeds be lost,

“Till when you have killed and wounded many of them” confirms Allah’s quest for genocide. Moe besieged the Banu Qurayzah until they surrendered. What he did after they surrendered serves to confirm the message of 8:67 & 47:4.

Sahih Volume 4, Book 52, Number 280:

Narrated Abu Sa’id Al-Khudri:

When the tribe of Bani Quraiza was ready to accept Sad’s judgment, Allah’s Apostle sent for Sad who was near to him. Sad came, riding a donkey and when he came near, Allah’s Apostle said (to the Ansar), “Stand up for your leader.” Then Sad came and sat beside Allah’s Apostle who said to him. “These people are ready to accept your judgment.” Sad said, “I give the judgment that their warriors should be killed and their children and women should be taken as prisoners.” The Prophet then remarked, “O Sad! You have judged amongst them with (or similar to) the judgment of the King Allah.”  [For more complete detail, refer to 5.59.448]

Moe arbitrarily slaughtered  about 700 prisoners of war.  What he did next should make your blood boil with outrage.

Abu Dawud Book 38, Number 4390:
Narrated Atiyyah al-Qurazi:
I was among the captives of Banu Qurayzah. They (the Companions) examined us, and those who had begun to grow hair (pubes) were killed, and those who had not were not killed. I was among those who had not grown hair.

First he decapitated the men, and cast them into a trench, then he did the same to their adolescent sons. Allah wants genocide and he gets it. Islam’s practice of genocide, mandated by Allah, is obviously not in conformity with the Convention on the Prevention and Punishment of the Crime of Genocide.

The Banu Qurayzah, Armenian, Assyrian  and Hindu genocides demonstrate a pattern of continuing crime against humanity. Islamic prophecy projects it far into the future:  to the end of the world. The following hadith is one of the clearest among several with similar content.

Abu Dawud Book 37, Number 4310:

Narrated Abu Hurayrah:

The Prophet (peace_be_upon_him) said: There is no prophet between me and him, that is, Jesus (peace_be_upon_him). He will descent (to the earth). When you see him, recognise him: a man of medium height, reddish fair, wearing two light yellow garments, looking as if drops were falling down from his head though it will not be wet. He will fight the people for the cause of Islam. He will break the cross, kill swine, and abolish jizyah. Allah will perish all religions except Islam. He will destroy the Antichrist and will live on the earth for forty years and then he will die. The Muslims will pray over him.

This saying, distilled to its essence, means that Jesus will return to make genocidal war upon the remaining remnant of Jews & Christians, destroying both populations. Besides being blasphemous, it is a token of Islam’s genocidal intent.

Confirmation of Islam’s intention is found in Ibn Kathir’s Tafsir of  7:167.

[]In the future, the Jews will support the Dajjal (False Messiah); and the Muslims, along with `Isa, son of Mary, will kill the Jews. This will occur just before the end of this world.[] Eternal Humiliation is Placed on the Jews

The violation of Article 1, 2.1 and 3.1 is obvious. Likewise, violation of  3.3 is easy to demonstrate by quoting one popular hadith.

Sahih Muslim Book 041, Number 6985:
Abu Huraira reported Allah’s Messenger (may peace be upon him) as saying: The last hour would not come unless the Muslims will fight against the Jews and the Muslims would kill them until the Jews would hide themselves behind a stone or a tree and a stone or a tree would say: Muslim, or the servant of Allah, there is a Jew behind me; come and kill him; but the tree Gharqad would not say, for it is the tree of the Jews.

That hadith tells Muslims that they can not obtain admission to Paradise and enjoy their rivers of wine and 72 houris until they exterminate the Jews.

ICERD, ICCPR & CPPCG condemn Islam and require its proscription by law. Who will enforce those international human rights covenants?  Do you have the courage and conviction to demand that the World Court enforce international law against Islam?  For the sake of justice, sign the International Qur’an Petition and send it to everyone you can hope to influence with an exhortation to sign and forward it.

Can’t We All Just Get Along?


Mohammed Haider Ghuloum PhD. quotes an AP Article from the Seattle Times about  the OIC’s campaign to impose Islamic blasphemy laws upon us. He then gives a good analysis of the problem, only to spoil the post with his conclusion.

I have a better idea: let’s have a new international law on religious tolerance and freedom. Mosques (Sunni and Shi’a), churches, synagogues, and temples of all faiths can be allowed to be freely built in any country. Be it Switzerland, Afghanistan, or Saudi Arabia. Nobody will be hassled for arriving at an airport carrying a copy of the Quran, the Bible, the Torah, Das Kapital, or Sarah Palin’s Confessions.. Would not that be much better?

International law on freedom of religion already exists.

ICCPR

Article 18

1. Everyone shall have the right to freedom of thought, conscience and religion. This right shall include freedom to have or to adopt a religion or belief of his choice, and freedom, either individually or in community with others and in public or private, to manifest his religion or belief in worship, observance, practice and teaching.2. No one shall be subject to coercion which would impair his freedom to have or to adopt a religion or belief of his choice.

3. Freedom to manifest one’s religion or beliefs may be subject only to such limitations as are prescribed by law and are necessary to protect public safety, order, health, or morals or the fundamental rights and freedoms of others.

4. The States Parties to the present Covenant undertake to have respect for the liberty of parents and, when applicable, legal guardians to ensure the religious and moral education of their children in conformity with their own convictions.

Unfortunately, nobody will enforce it and Islam denies it, imposing their own malicious substitute.

The Cairo Declaration on Human Rights in Islam

Article 1
(a)     All human beings form one family whose members are united by submission to God and descent from Adam.  All men are equal in terms of basic human dignity and basic obligations and responsibilities, without any discrimination on the grounds of race, colour, language, sex, religious belief, political affiliation, social status or other considerations.  True faith is the guarantee for enhancing such dignity along the path to human perfection.
(b)     All human beings are God’s subjects, and the most loved by him are those who are most useful to the rest of His subjects, and no one has superiority over another except on the basis of piety and good deeds.

Article 9
(a)     The quest for knowledge is an obligation, and the provision of education is a duty for society and the State.  The State shall ensure the availability of ways and means to acquire education and shall guarantee educational diversity in the interest of society so as to enable man to be acquainted with the religion of Islam and the facts of the Universe for the benefit of mankind.
(b)     Every human being has the right to receive both religious and worldly education from the various institutions of education and guidance, including the family, the school, the university, the media, etc., and in such an integrated and balanced manner as to develop his personality, strengthen his faith in God and promote his respect for and defence of both rights and obligations.

Article 22
(a)     Everyone shall have the right to express his opinion freely in such manner as would not be contrary to the principles of the Shari’ah.
(b)     Everyone shall have the right to advocate what is right, and propagate what is good, and warn against what is wrong and evil according to the norms of Islamic Shari’ah.
(c)      Information is a vital necessity to society.  It may not be exploited or misused in such a way as may violate sanctities and the dignity of Prophets, undermine moral and ethical values or disintegrate, corrupt or harm society or weaken its faith.
(d)     It is not permitted to arouse nationalistic or doctrinal hatred or to do anything that may be an incitement to any form of racial discrimination.

Article 24
All the rights and freedoms stipulated in this Declaration are subject to the Islamic Shari’ah.

Article 25
The Islamic Shari’ah is the only source of reference for the explanation or clarification to any of the articles of this Declaration.

Art. 9 should be your first hint.  The last two articles  seal the deal.  Shari’ah is what Allah & Moe said and did. It is codified in Reliance of the Traveller and you have no rights or freedoms not therein established  if Islam has its way.

Do you have the right to convert from Islam to atheism, Judaism or Christianity?

O8.1

When a person who has reached puberty and is sane voluntarily apostatizes from Islam, he deserves to be killed.

O8.2

In such a case, it is obligatory for the caliph (A: or his representive) to ask him to repent and return to Islam. If he does, it is accepted from him, but if he refuses, he is immediately killed.

Such non-Muslim subjects are obliged to comply with Islamic rules that pertain to the safety and indemnity of life, reputation, and property. In addition, they:

-6- are forbidden to openly display wine or pork, (A: to ring church bells or display crosses,) recite the Torah or Evangel aloud, or make public display of their funerals and feastdays;

-7- and are forbidden to build new churches.

The agreement is also violated (A: with respect to the offender alone) if the state has stipulated that any of the following things break it, and one of the subjects does so anyway, though if the state has not stipulated that these break the agreement, then they do not; namely, if one of the subject people:

-5- or mentions something impermissible about Allah, the Prophet (Allah bless him and give him peace), or Islam.

What would be impermissible to mention?

O8.7: Acts that Entail Leaving Islam

(O: Among the things that entail apostasy from Islam (may Allah protect us from them) are:

-4- to revile Allah or His messenger (Allah bless him and give him peace);

-5- to deny the existence of Allah, His beginingless eternality, His endless eternality, or to deny any of His attributes which the consensus of Muslims ascribes to Him (dis: v1);

-6- to be sarcastic about Allah’s name, His command, His interdiction, His promise, or His threat;

-7- to deny any verse of the Koran or anything which by scholarly consensus (def: b7) belongs to it, or to add a verse that does belong to it;

-16- to revile the religion of Islam;

-17- to believe that things in themselves or by their own nature have any causal influence independent of the will of Allah;

-18- to deny the existence of angels or jinn (def: w22), or the heavens;

-19- to be sarcastic about any ruling of the Sacred Law;

-20- or to deny that Allah intended the Prophet’s message (Allah bless him and give him peace) to be the religion followed by the entire world (dis: w4.3-4) (al-Hadiyya al-`Ala’iyya (y4), 423-24). )

Of course you have the right to live in peace, secure in your person and property?

Article 18
(a)     Everyone shall have the right to live in security for himself, his religion, his dependents, his honour and his property.
(b)     Everyone shall have the right to privacy in the conduct of his private affairs, in his home, among his family, with regard to his property and his relationships. It is not permitted to spy on him, to place him under surveillance or to besmirch his good name.  The State shall protect him from arbitrary interference.
(c)     A private residence is inviolable in all  cases.   It  will  not  be   entered  without permission  from  its   inhabitants  or  in  any unlawful manner, nor shall it be demolished or confiscated and its dwellers evicted.

Sorry, sucker. Refer to Art. 24 “All the rights and freedoms stipulated in this Declaration are subject to the Islamic Shari’ah.”.  Reliance O9.0 defines jihad and gives a partial scriptural basis for it. It also quotes a relevant hadith which should open your eyes.

“I have been commanded to fight people until they testify that there is no god but Allah and that Muhammad is the Messenger of Allah, and perform the prayer, and pay zakat. If they say it, they have saved their blood and possessions from me, except for the rights of Islam over them. And their final reckoning is with Allah”

Your blood and property are not sacred to Muslims until you become one of them. You are their prey and its open season.

I have a better idea: lets enforce the provisions of  ICCPR,  ICERD & CPPCG violated by Islam’s immutable intrinsic doctrines and outlaw it entirely.  You can advance this cause by signing the International Qur’an Petition, sending it to everyone you can hope to influence, and exhorting them to sign and forward it.

Ad Hoc Committee Leaves Work Unfinished


UN Watch published, in their blog, links to two apparently recent proposals for the protocol to be added to ICERD by the Ad Hoc Cmte. for the Elaboration of Complementary Standards. [The pdf  files contained scanned images, not text, so OCR was required. The format will not be an exact match and there may be errors I failed to spot. ] [Emphasis added.]

Provisions of these  proposals are in dispute.  It appears that the committee has been bogged down in procedural matters & disputes so that our freedom of expression may be safe for a few months at least, until their next session.

Proposals by Pakistan on behalf of OIC

1. State Parties States shall prohibit any propaganda, practice, or organisation aimed at justifying or encouraging any form of racial, ethnic, national and religious hatred or discrimination targeting people of particular groups, such as religious groups, refugees, asylum seekers, internally displaced persons, stateless individuals, migrants and migrant workers, communities based on descent, such as people of African descent, indigenous people, minorities and people under foreign occupation.

2. State Parties shall immediately undertake to adopt positive measures designed to eliminate all incitement to racial, ethnic, national and religious hatred or discrimination in and, to this end, shall commit themselves, inter alia:

  1. to declare an offence punishable by law all dissemination of ideas aimed at racial,  ethnic, national and religious       discrimination or hatred, as well as all acts of violence or incitement to such acts against any particular group of persons;
  2. to declare illegal and prohibit organizations, and also organized and all other propaganda  activities, which encourage and incite racial hatred or discrimination, and shall declare participation in such organizations or activities as an offence punishable by law;
  3. not to permit national or local public authorities incite racial, ethnic, national and religious hatred or discriininationg,
  4. not to permit political parties incite racial, ethnic, national and religious hatred or discrimination. .
  5. to strengthen their legislations or adopt necessary legal provisions to prohibit and suppress racist and xenophobic platforms and to discourage the integration of political parties who promote such platforms in govermnent alliances in order to legitimising the implementation of these platforms.


3. States Parties shall, in accordance with the human rights standards, declare illegal and to prohibit all organizations based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote national, racial and religious hatred and discrimination in any form.

4. States Parties shall promulgate, where they do not exist, a specific legislation prohibiting any propaganda for war and any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence.

To decode the substance of the highlighted expressions, we must keep one linguistic abuse constantly in mind:

4.  Emphasizes the urgent need to address the scourges of anti-Semitism, Christianophobia, and Islamophobia as contemporary forms of racism as well as racial and violent movements based on racism and discriminatory ideas directed at African, Arab, Christian, Jewish, Muslim and other communities;

That boilerplate from the Durban II Preliminary Document conflates criticism of Islam with racism. Consequently, references to racism in subsequent documents must be read more broadly.

What constitutes incitement to religious hatred?  In effect, any negative expression regarding Islam. This fact becomes clear when we examine the documents  behind previous resolutions: Fitna & the Danish Cartoons. The Secretary General made the matter abundantly clear.

Reuters quotes U.N. Secretary General Ban Ki-moon about Fitna:

“There is no justification for hate speech or incitement to violence,” Ban said in a statement. “The right of free expression is not at stake here.”

According to the Secretary General, a documentary juxtaposing verses from the Qur’an and the ravings of Imams with riots in the Arab street constitutes hate speech and incitement.  Geert Wilders proved that the Qur’an  inculcates hatred and  preaching it incites violence. That is truth, not hate speech!  The obvious intention and effect is to make all criticism of Islam a criminal offense.

ICCPR

Article 20

  1. Any propaganda for war shall be prohibited by law.
  2. Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law.

If Article 20 of ICCPR was enforced, the Qur’an would have to be outlawed as propaganda for war and advocacy of religious hatred inciting violence.

It is likely that the OIC’s proposal will be included, along with boilerplate from previous resolutions, in the anticipated Defamation of Religions resolution.  The Nigerian proposal differs: it omits provisions 3 & 4.

Ad Hoc Cmte.: Interesting Readers


Ad Hoc Committee on Complementary Standards was viewed 174 times on Bloggersbase, but only 10 times at Freedom Ain’t Free. I do not have a means of tracing readers at Bloggersbase, but Stat Counter‘s Visitor Activity Report revealed two interesting visitors.

Croatia’s Ministry Of Foreign Affairs viewed the post  September 15.  The United Nations Office At Geneva spent 24 minutes on the post September 16. No referral information was available for either visit.

The committee is scheduled to meet from October 19 to October 30 to work on their proposed protocol to ICERD. The purpose of the protocol is to criminalize criticism of Islam.

Now the UN is aware of the fact that Eye On the UN‘s reporting about their activities did not go entirely unnoticed. They probably don’t know yet that their own favorite weapon is being turned against them. Islam’s canon of scripture, tradition, exegeses & jurisprudence contravenes  vital provisions of ICERD, ICCPR & ICPPG. While Islam makes false accusations against its critics, we can  make accurate accusations against them.  We can prove the fact that Islamic doctrines subject the war cult to being banned under the provisions of those same covenants.

Some of that proof has been published in the International Qur’an Petition, also posted at Bloggersbase, where it drew only 96 readers. Seven previous blog posts detailing Islam’s contravention of international law were compiled into an e-book: Islam vs Human Rights which serves as an exhibit of evidence for the petition.

Now is the time for lovers of truth and liberty to stand up for those values by endorsing, publicizing and promoting the petition, just as Islam is ramping up its annual attack on our freedom of speech.

On September 14, Pakistan’s Ambassador to the UN, speaking on behalf of the OIC, made remarks about this issue.

The OIC would also like to point out that some of the worst forms of discrimination that lie at the heart of the contemporary human rights discourse such as defamation of religious, increased racial and religious discrimination, incitement to hatred, violence and related intolerance against specific individuals and communities have not found place in the High Commissioners statement. Respect for religious and cultural diversity is fundamental towards achieving die objective of discrimination free societies and a world of equal treatment for all. Calls for restrictions on religious symbols, dress codes or construction of religious sites run contrary to the fundamentals of human rights and must be addressed.  We do hope that these important issues will be duly addressed by the High Commissioner in future.

Note their priorities: defamation of Islam is one of the worst forms of discrimination at the heart of human rights discourse.  Deaths and displacements caused by their Jihad don’t concern them. Slavery is not an issue. Assaults, rapes and impositions against religious minorities in Asia, Africa and Egypt don’t rank in their list of human rights issues.  Religious discrimination: Jizya imposed upon Christians. Incitement to hatred: read the Qur’an.  Violence: its called Jihad and is being waged in Asia & Africa against Christians and Hindus.   Dress codes: have you read the Pact of Umar? Construction of religious sites: try to build a church in Egypt or Saudi Arabia!  The arrogance and hypocrisy of Islam know no bounds.  Lets throw these issues back in their face.

If you value peace, truth and justice, now is the time to demonstrate  their importance to you by endorsing, publicizing and promoting the International Qur’an Petition.

International Qur’an Petition


A new on line petition, inspired by the Calcutta Qur’an Petition, has been created for the purpose of increasing public awareness of Islamic doctrines which are inimical to life and liberty. The petition focuses on several ayat which stand in egregious violation of important provisions of international human rights accords.

Regular readers of my blog posts know that I make frequent use of quotes from Islam’s canon of scripture, tradition & jurisprudence. To keep the petition moderate in size, those quotes were trimmed down to the most essential clauses. A separate document containing the full quotes has been published and linked in the petition.

A new Facebook group was created to aid in promoting the petition. A slightly edited version of the petition follows, including a link to the page where readers can add their signatures to it.


Whereas Islam and its apologists accuse Kuffar of inculcating hatred of Muslims and inciting violence against them;  and

Whereas Islam is pursuing national and international legislation to impose their blasphemy laws upon us so as to prevent or punish exposure of their execrable doctrines which inculcate hatred, incite violence and sanctify & mandate genocidal, terroristic conquest; the intent of which legislative campaign is to render us defenseless;

Now, therefore, the undersigned Kufar & Harbi do declare, swear and demonstrate proof from the ample testimony of Allah and his Messenger that Islam is and will always be in egregious violation of the recognized rights of free men and must therefore be condemned and proscribed:

Article 4 of ICERD condemns “all propaganda and organizations which are based on ideas or theories of superiority …or which attempt to justify or promote racial hatred and discrimination in any form.  Section b: “Shall declare illegal and prohibit organizations, and also organized and all other propaganda activities, which promote and incite racial discrimination, and shall recognize participation in such organizations or activities as an offense punishable by law;”.

Surah Al-Imran 110 declares Muslims to be the “best of peoples ever raised up for mankind”.  Sahih Bukhari 6.60.80 explains the meaning of that passage thusly: ” the best of peoples for the people, as you bring them with chains on their necks till they embrace Islam”.   That is clear proof of supremacism related to ethnic violence.

Surah Al-Baqarah  91 contains a pretext for hatred of Jews: Say (O Muhammad Peace be upon him to them): “Why then have you killed the Prophets of Allah aforetime, if you indeed have been believers?” .

Surah Al-Baiyyinah  6 contains another pretext for hatred of Jews & Christians: “They are the worst of creatures”.

Surah At-Taubah 29 commands  warfare against Jews & Christians: “Fight against those who … among the people of the Scripture  until they pay the Jizyah with willing submission, and feel themselves subdued.”.

Surah At-Taubah 30 curses Jews & Christians: “And the Jews say: ‘Uzair (Ezra) is the son of Allah, and the Christians say: Messiah is the son of Allah. … Allâh’s Curse be on them, how they are deluded away from the truth!

It is obvious upon the face of the text that the quoted ayat incite hatred of Jews & Christians, declare war upon them and curse them.  There can be no doubt that Islam’s canon of scripture is in egregious violation of Article 4 and must therefore be condemned.  Under section b quoted above, Islam must be declared illegal and prohibited.

Article 6 of ICCPR gurantees the right to life.  “Every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life.”

By declaring perpetual war, Islam egregiously violates the right to life. We know that Jihad is perpetual because the declarations in Al-Anfal 39 & At-Taubah 29 are outcomne oriented and unlimited geographically and chronologically. Furthermore,  the testimony of Islam’s founder is recorded in Sunan Abu Dawud 14.2526: “jihad will be performed continuously since the day Allah sent me as a prophet until the day the last member of my community will fight with the Dajjal (Antichrist).”.

Islam’s founder also testified in Sahih Bukhari 1.8.387 that Islam has no respect for the sanctity of life: “if they say so, pray like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will be sacred to us”.

Article 20 of ICCPR proscribes “Any propaganda for war ” and “Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence”, declaring that they shall be prohibited by law.

Islam’s canon of scripture contains three egregious commands to aggression which obviously violate Article 20: Al-Anfal 39, At-Taubah 29 & 123. “fight them until there is no more Fitnah”, “Fight against those who” & “Fight those of the disbelievers who are close to you” have obvious meaning which can not be denied. The commands are confirmed by Islam’s founder in Sahih Bukhari 4.52.196: ” I have been ordered to fight with the people till they say, ‘None has the right to be worshipped but Allah,'”.

Surah At-Taubah  38 condemns Muslims who refuse to participate: “What is the matter with you, that when you are asked to march forth in the Cause of Allah (i.e. Jihâd) you cling heavily to the earth? “… “If you march not forth, He will punish you with a painful torment.”.

Surah As-Saff 10-12 incentivize participation in Jihad by promising escape from Hell and admission to Paradise in exchange for participation in Jihad:
“a commerce that will save you from a painful torment. … and that you strive hard and fight in the Cause of Allah with your wealth and your lives …  He will forgive you your sins, and admit you into Gardens under which rivers flow”.

Surah Al-An’am 115 “None can change His Words” and Surah Ar-Rum 30 “No change let there be in Khalq­illâh (i.e. the Religion of Allah Islamic Monotheism)” clearly proscribe editing the Qur’an. It can not be rendered anodyne.

The Qur’an is a violation of international law and it can’t be edited; preaching it and propagating its doctrines must therefore be prohibited.  One of the cited ayat: At-Taubah 29, is cited as the scriptural basis of  Reliance of the Traveller Book O, Chapter 9, Paragraph 8 which Islamic law declares that the Caliph makes war upon Jews, Christians and Zoroastrians.

Islamic tradition informs us that Jihad will continue until Judgment Day, and that Muslims would be cursed for abandoning it.  Sunan Abu Dawud 14.2526:   “jihad will be performed continuously since the day Allah sent me as a prophet until the day the last member of my community will fight with the Dajjal “.

Sunan Abu Dawud 23.3455: “and give up conducting jihad (struggle in the way of Allah). Allah will make disgrace prevail over you, and will not withdraw it until you return to your original religion”.

From this narration, it becomes obvious that Islam and Jihad are synonymous. Since Islam asserts a divine mandate and right to wage war against us, to kill us, rape our widowsenslave our orphans and seize our real and personal property, we can not enjoy our God given right to life.  We have shown the court that Islamic doctrine, practice & jurisprudence violate the international covenants which guarantee our human rights.

Since Muslims are promised eternity in a celestial bordello for participating in Jihad and threatened with eternal damnation if they refuse, it is impossible that free men can live in peace and security while Islam exists upon the face of the earth.  We therefore pray for injunctive relief:  proscription of the practice and propagation of Islam.

Ad Hoc Cmte: Non-Paper


On December 5, 2008, there was issued, on the letterhead of the High Commissioner For Human Rights, by Ambassador Idriss Jazairy, President of the Ad Hoc Committee on Complementary Standards, a “Non-Paper Paper” and a cover letter explaining its purpose. [Emphasis & links added.]
[Due to the use of OCR to extract quotes from scanned document images, there will be some spelling errors and a few Anglicized words will be Americanized. ]

The purpose of this “Non paper” is to stimulate a constructive debate on the content and the framework of major areas of vulnerability which for reasons of substance and/or of procedure suffer from protection gaps. Some of these areas are related to the contemporary manifestations of racism, ~ racial discrimination, xenophobia and related intolerance.The purpose of this “Non-paper” is also to invite concrete responses and recommendations based on its content.

The Ambassador set forth the Non Paper’s terms of reference.

  • Paragraph 199 of the Durban Declaration and Programme of Action that recommended to the Commission on Human Rights, now replaced by the Human Rights Council, to elaborate complementary intenational standards aimed at strengthening and updating international instruments against all forms of racism, racial discrimination, xenophobia and related intolerance.
  • Decision 3/IO3 of the Human Rights Council that decides, in pursuance of decision and instruction of the 2001 World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance to establish an Ad Hoc Committee of the Human Rights Council with the mandate to elaborate, as a matter of priority and necessity, complementary standards in the form of either a convention or additional protocol (s) to the International Convention on the Elimination of All Forms of Racism, racial Discrimination, Xenophobia and related Intolerance that will ill the existing gaps in the Convention and also provide new normative texts aimed at combating all forms of contemporary racism, including incitement to racial and religious hatred.
  • Resolution 6/21 of the Human Rights Council on the elaboration of new international complementary standards to the International Convention on the Elimination of All Forms of Racial Discrimination.

The following listed phrases are critical because they are encoded to conceal the true intentions of the committee.

  • all forms of racism
  • related intolerance
  • incitement to racial and religious hatred

We must always bear in mind how the United Nations twist the English language!!! The following quote is from Preliminary document of the African Regional Conference Preparatory to the Durban Review Conference [Emphasis added.]

4. Emphasizes the urgent need to address the scourges of anti-Semitism, Christianophobia, and Islamophobia as contemporary forms of racism as well as racial and violent movements based on racism and discriminatory ideas directed at African, Arab, Christian, Jewish, Muslim and other communities;

Islamophobia = racism!!!

The Ambassador directed the member states to keep in mind::

all views expressed and contributions made within the framework of the follow-up mechanisms of the Durban Declaration and Programme of Action, including:

  • The survey of the five experts on the nature and the scope of substantive gaps, with regard to issues of content in the existing international instruments to combat racism, racial discrimination, xenophobia and related intolerance (A/HRC/4/W G.3/ 6) ;
  • The document of the Committee on the Elimination of racial discrimination on possible measures to strengthen the implementation of the final observations by adopting new recommendations by updating its monitoring procedures (All-IRC/4/WG.3/7)
  • The responses provided by the Committee ou the Elimination of racial discrimination to the questionnaire by the UN High Commissioner for Human Rights pursuant to decision PC.1/ 10 of the Preparatory Committee of the Durban Review Conference (A/CON’F.2l1/PC.2/CRP.5) including the relevant points of view made by the Members ofthe Committee on behalf ofthe latter; ~
  • The Report of the 5th session of the Intergovernmental Working Group on the Effective implementation of the Durban Conference and Prcgrarnmc of Action (A/HCR/6/10) and all relevant recommendations and conclusions adopted by this Group since its creation, particularly those contained in document(AH.CR/AC.!/I/CRP.2);
  • The discussions that took place during the first session of the Ad hoc Committee on complementary standards, held from 18 to 2l February 2008.

The Ambassador lists the following revelations from the two previous sessions.

  • There is global collective agreement and commitment expressed during the 2001 World Conference against racism on the principle of claborating international complementary standards to strengthen and update the international instruments against all forms of racism, racial discrimination, xenophobia and related intolerance (para 199 of the Durban Programme of Action);
  • However, no consensus was reached on how the specific form of/manner of giving concrete expression to this commiuncnt in priciple;
  • We must also bear in mind the ensuing debate on the links between articles 19 and 20 of the International Covenant on civil and political rights and the expert meeting of 2 and 3 October 2008, whereafter it was reiterated that the fundamental right of freedom of expression is compatible with the prohibition of any call for national, racial or religious hatred which constitutes incitement to discrimination, hostility and violence;
  • It is thus imperative to reach the largest possible agreement, through the Ad hoc Committee on complementary standards, on concrete ways and means to implement the commitment in principle made: during the 2001 World Conference against racism.
  • The approach suggested to achieve this goal is to stimulate, in a positive and inclusive spirit, concrete proposals on the fields and themes laid out in the “Non paper” for which complementary standardized provisions or other measures designed to fill protection gaps, are necessary.

Of course, the revelations repeat certain code phrases.

  • all forms of racism
  • related intolerance

Next, we encounter a reference to ICCPR.

  • the fundamental right of freedom of expression is compatible with the prohibition of any call for national, racial or religious hatred which constitutes incitement to discrimination, hostility and violence

Muslims, liars, lawyers & U.N. bureaucrats do not use words the way normal people do. “call for national, racial or religious hatred which constitutes incitement to discrimination, hostility and violence” means any criticism of Islam, specifically the Danish Cartoons & Fitna. In this context, it is asserted that censorship of criticism of Islam does not interfere with freedom of expression.

The Non-Paper begins with a listing of its Purpose, scope and parameters:

  • Implementing paragraph 199 of the Programme of Action of the World Conference against racism, racial discrimination, xenophobia and related intolerance, in which the Conference “Rec0Recommends that the Commission on Human Rights prepare complementary international standards
  • to strengthen and update international instruments against racism, racial discrimination, xenophobia and related intolerance in all their aspects”, as well as the relevant Human Rights Council resolutions, in particular decision 3/103 .
  • The need to enhance efforts to counter contemporary and emerging forms of manifestations of racism, racial discrimination, xenophobia and related intolerance.
  • The need to strengthen the monitoring procedures of the Committee on the Elimination of Racial Discrimination with a view to enable it to undertake the responsibilities entrusted to it in a more effective manner.
  • The need to address double or multiple discrimination a continuing source of concern, as it affects certain individuals and groups, in particular gender-related racial discrimination and double discrimination on the grounds of race and religion.
  • The imperative to ensure that measures to combat terrorism respect the fundamental principles and the universally recognized standards of international law, international human rights law and international humanitarian Law.
  • The urgency of addressing racial profiling and eliminating it as a pervasive form of discrimination.
  • The need for uniform and consistent application of the law at the national and international levels to ensure the effectiveness of international efforts to counter racism and racial discrimination.
  • The need to recognize that The prohibition of the dissemination of all ideas based upon racial superiority or hatred and the prohibition of incitement to national, racial -· or religious hatred are compatible with the freedom of opinion and expression.
  • The principle of regarding provocative portrayals of objects of religious veneration as a malicious violation of the spirit of tolerance which must also be a feature of democratic society.
  • The need to re-emphasize that the prohibition of publication of material with the aim of protecting the rights of others and against seriously or gratuitously offensive attacks on matters regarded as sacred by the followers of any religion is a legitimate State objective.
  • The need for national and international law to provide adequate legal responses to propaganda of a racist and xenophobia nature committed through computer systems.
  • The need to follow the growing trend in many States to include, in their criminal I legislation, offenses in which religious motives are an aggravating factor.

Once again, the code phrases rear their ugly heads.

3- Terrorism, racial discrimination and racial profiling:

  1. A definition of racial profiling, prioritizing human rights protection, could be elaborated and agreed upon.
  2. States must ensure that measures to combat terrorism do not discriminate, in purpose or effect on ·grounds of race, colour, descent or national or ethnic origin, as well as on religious grounds, bearing in mind in this context the intersectionality between racial and religious discrimination.
  3. Profiling based on stereotypes founded on grounds of discrimination prohibited by international law, including on racial, ethnic and/or religious grounds must be prohibited by law.

Who practices terrorism? Are the majority of terror attacks perpetrated by little old ladies from Iceland? Terrorism is an intrinsic sacrament of Islam, established as such by 3:151, 8:12., 8:60, 33:26, 59:2 & 59:13. When you hear hoof beats, they probably come from horses, not from unicorns. Profiling according to current trends in the identity of perpetrators is common sense. Islam is acting through the UN to disarm us.

The fifth listed theme gets down to detail.

5- Incitement to racial, national and religious hatred

  1. There is a need for further clarifying and reinforcing at the international level existing obligations on the eradication of all incitement to hatred and ‘ discrimination in any form and to prohibit by law, propaganda for war and advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence.
  2. In this context, complementary standards to be developed should observe the following parameters:
    • Article 4 of ICERD shall be extended to the crime of incitement to racial hatred covering offenses motivated by religious hatred against immigrant communities.
    • The protection provided shall extend to all individuals and groups within the jurisdiction of the State Party.
    • The prohibitions shall equally cover acts committed by any individual, group or organization, including political and media organizations as well as by national or local public authorities.
    • The provisions shall apply to any act which, in purpose or effect, incites discrimination, hostility or violence.
    • In order to achieve consistent and uniform application and maximize protection for actual or potential victims, any doubt as to the existence of a causal link between an act of incitement and the likelihood of a violation, or the threshold required for reaching such a determination, shall be interpreted in a consistent and coherent manner at the national and international levels so as to ensure appropriate protection of the concerned individuals or groups.
    • Addressing acts constituting incitement shall apply whether such acts have aims which are internal or external to the State concerned.
    • Requisite standards would explicitly not prohibit advocacy of the sovereign right to self-defence or the right of peoples to self-determination and independence in accordance with the Charter of the United Nations.
    • Requisite complementary standards shall include the prohibition of publication of material that direct seriously offensive attacks on matters regarded by followers of any religion or belief as sacred or inherent to their dignity as human beings, with the aim of protecting them against such attacks.
  3. In line with the above parameters, States’ general obligations would include:
    • Undertaking to promulgate, where they do not exist, a specific legislation prohibiting any propaganda for war and any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence.
    • Asserting, in the relevant specific legislation, that such propaganda and advocacy are contrary to public policy.
    • Providing for appropriate sanction, including of a criminal nature, in case of violation.

The listed item under sub section c would appear to be straightforward. It is not. Muslims, liars, lawyers and U.N. Bureaucrats do not use the English language to communicate, they use it to deceive! In evidence whereof I cite the egregious remarks of the Secretary General on the subject of Fitna, the short documentary by Girt Wielders.

Reuters quotes U.N. Secretary General Ban Ki-moon about Fitna:

“There is no justification for hate speech or incitement to violence,” Ban said in a statement. “The right of free expression is not at stake here.”

Fitna does not incite violence, it documents incitement contained in the Qur’an and propagated by Imams in their Mosques

The program of the Ad Hoc Committee runs parallel to the programs of the General Assembly and Human Rights Council in their resolutions combating “defamation of religion” and that of the Durban II review conference. Those programs are documented in detail and their egregious hypocrisy exposed and documented in the following listed blog posts..

Durban II Draft 4/15/09


As the Durban II Draft evolved, its redundancy has been reduced, but its objectionable elements remain intact. It singles out Israel for unwarranted condemnation and demands criminalization of truthful criticism of Islam.  For those reasons, I urge President Omama and Secretary of State Clinton to stand by the decision to stay away from the Racism Conference  We must not lend any legitimacy to that travesty.  I urge the House & Senate to pass resolutions condemning the Durban II Draft Document and to refuse to subsidize it with our tax dollars.

Draft outcome document as at 15 April 2009 at 9:00 am as amended by the Chair (4/15/2009)

1. Reaffirms the Durban Declaration and Programme of Action (DDPA), as it was adopted at the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance in 2001; [adopted ad ref]

Paragraph one is unacceptable because the referenced text singled out Israel for condemnation, ignoring the human rights violations, genocides & racism of other nations. It is also unacceptable because it demands criminalization of criticism of Islam.  President Obama recently cited this paragraph as his main reason for deciding not to participate in the conference.

7. Reiterates that poverty, underdevelopment, marginalization, social exclusion and economic disparities as well as foreign occupation are closely associated with racism, racial discrimination, xenophobia and related intolerance and contribute to the persistence of racist attitudes and practices which in turn generate more poverty;

“Foreign occupation” is a code phrase for Israel bashing.  The “racist attitudes and practices” which produce poverty flow directly from the Qur’an & hadith.

11. Recognizes with deep concern the negative stereotyping of religions resulting in denial or undermining the rights of persons associated with them and the global rise in the number of incidents of racial or religious intolerance and violence, including Islamophobia, anti-Semitism, Christianophobia and anti-Arabism and urges all the UN Member-States to implement the paragraph 150 of the DDPA ;

Paragraph 11 is a prime example of the pot calling the kettle black. It complains, by code words, of the Danish Cartoons and FITNA.  The cartoons depict Moe as a terrorist, which he was, by his own admission. FITNA displays quotes from the Qur’an, juxtaposed with their practical application. The only right impaired by FITNA was the cartoonist’s copyright because one cartoon was used without permission. The intolerance and violence belong to the adherents of Islam, who, stirred up by rabble rousing rants at Friday prayer service, rioted in the streets.

The referenced paragraph from the DDPA reads as follows.

150. Calls upon States, in opposing all forms of racism, to recognize the need to
counter anti-Semitism, anti-Arabism and Islamophobia world-wide, and urges all States to take effective measures to prevent the emergence of movements based on racism and discriminatory ideas concerning these communities;

Thus paragraph 11 demands, by reference, that national laws be passed and executed to criminalize criticism of Islam.  This demand, which is incompatible with our First Amendment, is another reason for non-participation cited by President Obama.

12. Reaffirms that any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law; reaffirms further that all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts shall be declared offence punishable by law, in accordance with the international obligations of States and that these prohibitions are consistent with freedom of opinion and expression;

The first sentence of paragraph 12 is aimed directly at the Danish Cartoons and FITNA.  In actual fact, the Qur’an, Islam’s canon of sacred scripture, is replete with “religious hatred that constitutes incitement to discrimination, hostility or violence”.

Secretary General Ban Ki-moon’s condemnation of FITNA makes the matter absolutely clear, leaving no doubt.  The last clause in par. 12 is an obvious lie. The intent is to criminalize all criticism of Islam, including its mandates of perpetual war, genocide and terrorism.  If we can not discuss the doctrines and practices of our enemy, we can not effectively advocate  national defense against Islam’s campaign of terror.

15. Expresses its appreciation for progress made in addressing the situation of the victims of racism, racial discrimination, xenophobia and related intolerance identified in the Durban Declaration and Programme of Action, while regretting that racism, racial discrimination, xenophobia and related intolerance, including their contemporary forms and manifestations, still persist;

“Contemporary forms and manifestations” is a code phrase for criticism of Islam. Take note of  this declaration contained in the preliminary document. [Emphasis added.]

4.  Emphasizes the urgent need to address the scourges of anti-Semitism, Christianophobia, and Islamophobia as contemporary forms of racism as well as racial and violent movements based on racism and discriminatory ideas directed at African, Arab, Christian, Jewish, Muslim and other communities;

Objection to Islam’s continual aggression is conflated with racism. You can substitute objection to Islam wherever “racism” or “contemporary forms and manifestations” is printed in the Durban Draft.


16. Acknowledges that there should be no hierarchy among emerging and resurgent forms of racism, racial discrimination, xenophobia and related intolerance and that all victims should receive the same necessary attention and protection, and accordingly appropriate treatment;

Paragraph 16 is part of the effort to wrap Islam in the false mantle of victimhood. In their view, Muslims offended by the Danish Cartoons suffer equally with the Jews murdered by Hitler.


38. Urges States parties to the Convention to withdraw reservations contrary to the object and purpose of the Convention and to consider withdrawing other reservations;

The quote below comes from Wikipedia. It describes our reservation to ICERD.

The U.S. has attached a reservation to its 1994 ratification of the treaty noting that specifically the treaty’s restrictions on freedom of speech and freedom of assembly were incompatible with the guarantees of such freedoms incorporated into the First Amendment to the Constitution of the United States.[20][21]

SECTION 5: Identification of further concrete measures and initiatives at all levels for combating and eliminating all manifestations of racism, racial discrimination, xenophobia and related intolerance, in order to foster the implementation of the DDPA and to address challenges and impediments hereto, including in light of developments since its adoption in 2001

Remember that “related intolerance” means criticism of and objection to Islam’s perpetual aggression.


52. Stresses the need for mobilizing the political will of relevant actors at all levels which is essential to eliminate racism, racial discrimination, xenophobia and related intolerance;

Paragraph 52 is a code expression demanding legislation criminalizing criticism of Islam, in clear contravention of the First Amendment.


53. Reaffirms the positive role that the right to freedom of opinion and expression, as well as the full respect for the freedom to seek, receive and impart information can play in combating racism, racial discrimination, xenophobia and related intolerance;

Paragraph 53 praises the condemned man before executing him. The expressions are Orwellian in the extreme.


54. Calls on States to undertake effective media campaigns to enhance the struggle against all manifestations of racism, racial discrimination, xenophobia and related intolerance, inter alia, by disseminating and giving adequate visibility to the DDPA and its follow-up mechanisms; [adopted ad ref]

55. Calls on States to take effective, tangible and comprehensive measures to prevent, combat and eradicate all forms and manifestations; [adopted ad ref]

Paragraph 54 demands a propaganda campaign. Paragraph 55 demands national legislation to criminalize criticism of Islam.


56. Calls on States to combat impunity for acts of racism, racial discrimination, xenophobia and related intolerance, to secure expeditious access to justice, and to provide fair and adequate redress for victims; [adopted ad ref]

Paragraph 56 translates into a demand for punishment of the cartoonists and Geert Wilders, with legislation allowing Muslims to sue them for “damages”.

57. Stresses that the right to freedom of opinion and expression constitutes one of the essential foundations of a democratic, pluralistic society and stresses further the role these rights can play in fight against racism, racial discrimination, xenophobia and related intolerance worldwide;

Paragraph 57 shows us how clever the OIC thinks they are;. giving faint praise before wielding their sword.


59. Urges States to punish violent, racist and xenophobic activities by groups that are based on neo-Nazi, neo-Fascist and other violent national ideologies; [adopted ad ref]

Paragraph 59 is obviously a coded attack upon the Dutch Freedom Party and a similar party in Belgium.


66. Calls upon States to ensure that any measures taken in the fight against terrorism are implemented in full respect of all human rights, in particular the principle of non-discrimination and in this context urges all Member-States to implement relevant provisions of the General Assembly resolutions 60/288 and 62/272;

Paragraph 66 is a coded condemnation of our half hearted attempts at homeland security subsequent to 9/11.


67. Expresses its concern over the rise in recent years of acts of incitement to hatred, which have targeted and severely affected racial and religious communities and persons belonging to racial and religious minorities, whether involving the use of print, audio-visual or electronic media or any other means, and emanating from a variety of sources;

Paragraph 67 is redundant; restating paragraph 12 above.


68. Resolves to, as stipulated in art. 20 of the ICCPR, fully and effectively prohibit any advocacy  of national, racial, or religious hatred that constitutes incitement to discrimination, hostility or violence and implement it through all necessary legislative, policy and judicial measures;

Paragraph 68 is redundant, restating paragraph 12 above.


98. Calls upon States, in accordance with their human rights obligations, to declare illegal and to prohibit all organizations based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote national, racial and religious hatred and discrimination in any form, and to adopt immediate and positive measures designed to eradicate all incitement to, or acts of, such discrimination;

If paragraph 98 were sincere and enforced, Islam would be outlawed.


101. Calls upon States not to resort to profiling founded on grounds of discrimination prohibited by international law, including on racial, ethnic, and religious grounds and prohibit it by law;

Paragraph 101 is redundant, restating paragraph 66.


133. Takes note of the proposal of the OHCHR, in cooperation with regional stakeholders in all parts of the world, to organize as a follow-up to the OHCHR Expert Seminar on the links between art.19 and 20 of the ICCPR a series of expert workshops to attain a better understanding of the legislative patterns, judicial practices and national policies in the different regions of the world with regard to the concept of incitement to hatred, in order to assess the level of implementation of the prohibition of incitement, as stipulated in article 20 of the ICCPR, without prejudice to the mandate of the Ad Hoc Committee on the Complementary Standards;

Art. 19  of  ICCPR declares rights to “hold opinions without interference” & “freedom of expression”  and outlines certain limitations thereon.  Art. 20  prohibits “propaganda for war” and “advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence”.

What is the big deal about the “Ad Hoc Committee on the Complementary Standards”? Its report, of course. The committee generated a proposed protocol to be added to ICERD. The protocol would criminalize “defamation of religions”, as demanded by the OIC. I am unable at present to find the text of the proposal. These references hint at it. The Censorship Protocol


This is what the IHEU is warning about in their  press release, as the second of three listed threats to liberty.

Call upon all governments to resist the efforts of the “Ad Hoc Committee on Complementary Standards” to alter the ICERD;.

This draft complementary international standards in the fight against racism, racial discrimination, xenophobia and related intolerance has been prepared for the implementation of paragraph 199 of the Program of Action(A/CONF.189/12).

199. Recommends that the Commission on Human Rights prepare complementary
international standards to strengthen and update international instruments against racism, racial
discrimination, xenophobia and related intolerance
in all their aspects;

Article 4 of the proposed protocol to ICERD  is titled: Prohibition of Incitement to Racial Hatred.
This article contains several notable provisions.

  1. States Parties condemn all propaganda, practice or organization to justify or encourage any form of hatred or discrimination against persons belonging to groups such as religious groups, refugees, asylum seekers, people displaced, stateless persons, migrants and migrant workers, descent-based communities such as people of African descent, indigenous peoples, minorities and people under foreign occupation.
  2. States Parties undertake to adopt immediate and positive measures designed to eradicate all incitement to such hatred or discrimination, including:
  1. to declare an offense punishable by law all dissemination of ideas to such discrimination or hatred, as well as all acts of violence or incitement to such acts directed against persons belonging to particular groups;
  2. to declare illegal and prohibit organizations and propaganda activities organized and any other type of propaganda which incites hatred or discrimination or who encourages, and to declare punishable by law the involvement in such organizations or activities;
  3. not permit public authorities, national or local, to incite hatred or discrimination;
  4. not to allow political parties to incite hatred or discrimination.
  5. to strengthen their laws or take the legal provisions necessary to prohibit and punish racist and xenophobic platforms and discourage by a democratic debate vigilant the integration of political parties promoting these platforms in Government to legitimise their implementation alliances.

This protocol to ICERD would become International law, binding on signatories, and a provision in  Article 17 prohibits reservations. We need a definition of terms:

  • justify or encourage any form of hatred or discrimination
  • incites hatred
  • racist and xenophobic

Here is a clue from Article 6.

The fundamental characteristic of all the events to certain religions and descriditer to insult people or groups who share the religion, commonly called “defamation of religions” and all the fear and religious discrimination is inciting racial hatred For religious and address the issue of defamation of religions in a universal, it is essential to bring this discussion to the international instruments on human rights.

According to that, anyone who says or writes anything negative about Islam incites racial hatred.  Is that clear yet?  Examine what U.N. Secretary General Ban Ki-moon said about Geert Wilders’ Fitna:.

“There is no justification for hate speech or incitement to violence,” Ban said in a statement. “The right of free expression is not at stake here.”[Reuters]

Geert Wilders quoted the Qur’an and displayed images of rabble rousing Imams and their followers, along with some of the results of their preaching.  Ban Ki-moon says that constitutes hate speech and incitement to violence.

Masood Khan quoted Ban Ki-Moon’s representative to the Alliance of Civilizations as declaring Fitna to be ” a deliberate incitement to discrimination,  violence and hatred on grounds of religion, aimed at provoking and promoting social unrest”. [Masood Khan’s statement of 04/01/08]

If  we accurately describe Islam’s doctrines & practices, quoting its canon of scripture, tradition & jurisprudence, we are automatically convicted of hate speech; inciting violence. This is part of an Orwellian campaign to dis-arm us, to render us incapable of warning against Islamic aggression.

This protocol would outlaw two American and two European political parties for their anti-Islam platforms.  Muhammad, claimed to be the best and greatest of men, worthy of emulation as a role model was a murderer, pedophileterrorist. For genuine hate speech and incitement to violence, read the Qur’an, don’t stop there, read the next six verses. Is cursing Jews & Christians hateful enough for you? How about genocide? He killed all the men of a Jewish village after they surrendered, then he examined the boys for pubic hair and slaughtered those who had it.

Islam seeks to criminalize its critics because it has no defense against the facts contained in its own canon of scripture, tradition & jurisprudence.  Moe had good reason for forbidding his followers to carry the Qur’an into Dar al-Harb: “That is out of fear that the enemy will get hold of it.”

Don’t just sit there waiting for the noose to be placed on your neck.  Send an email to your Senators, and to President Obama. Tell them that the proposed protocol is unacceptable. Tell them that you consider support for it to be tantamount to treason.  You can send your email through the Federal Officers link at http://www.congress.org/ . Include a link to this blog post in your email so that your Senators can become informed.
