O9.1: The Obligatory Character of Jihad

Jihad is a communal obligation (def: c3.2).  When enough people perform it to successfully accomplish it, it is no longer obligatory upon others (O: the evidence for which is the Prophet’s saying (Allah bless him and give him peace),

He who provides the equipment for a soldier in jihad has himself performed jihad,”

and Allah Most High having said:

“Those of the believers who are unhurt but sit behind are not equal to those who fight in Allah’s path with their property and lives. Allah has preferred those who fight with their property and lives a whole degree above those who sit behind. And to each, Allah has promised great good” (Koran 4:95).

If none of those concerned perform jihad, and it does not happen at all, then everyone who is aware that it is obligatory is guilty of sin, if there was a possibility of having performed it. In the time of the Prophet (Allah bless him and give him peace) jihad was a communal obligation after his emigration (hijra) to Medina. As for subsequent times, there are two possible states in respect to non-Muslims.

The first is when they are in their own countries, in which case jihad (def: o9.8) is a communal obligation, and this is what our author is speaking of when he says, “Jihad is a communal obligation,” meaning upon the Muslims each year. …

Tafsir

This is the first of several posts from Islamic Law: Sharia. The highlighted sentence in the final paragraph of the quote above has the effect of a legal ruling that military expeditions against Kuffar must be mounted in every year, similar to the rulings of Al-Ghazali & Al-Shafi’i.

Previously, I quoted from the Qur’an, then from each of the four major Hadith collections, which confirm and amplify it.  Now, as the series comes to a close, I quote from Islamic law, which is derived from and gives further confirmation to Islam’s canon of scripture and tradition.

Who has the wisdom to read Sharia and comprehend its full enormity? Who has the fortitude to share their new found knowledge by cross posting this installment of Myth vs Fact?

The free world needs to know exactly what it is up against in an existential conflict. Please join me in making this knowledge readily available.

Myth vs Fact #476

Myth Fact
Islam: Religion of peace. Malik’s Muwatta Book 48, Number 48.1.1:

Yahya related to me from Malik from Zayd ibn Aslam that Jabir ibn Abdullah al-Ansari said, “We went out with the Messenger of Allah, may Allah bless him and grant him peace, in the raid on the Banu Ammar tribe.” Jabir said, “I was resting under a tree when the Messenger of Allah, may Allah bless him and grant him peace, came. I said, ‘Messenger of Allah; come to the shade.’ So the Messenger of Allah, may Allah bless him and grant him peace, sat down, and I stood up and went to a sack of ours. I looked in it for something and found a small cucumber and broke it. Then I brought it to the Messenger of Allah, may Allah bless him and grant him peace. He said, ‘From where did you get this?’ I said, ‘We brought it from Madina, Messenger of Allah.’ ”

Jabir continued, “We had a friend of ours with us whom we used to equip to go out to guard our mounts. I gave him what was necessary and then he turned about to go to the mounts and he was wearing two threadbare cloaks of his. The Messenger of Allah, may Allah bless him and grant him peace, looked at him and said, ‘Does he have two garments other than these?’ I said, ‘Yes, Messenger of Allah. He has two garments in the bag.’ I gave them to him. He said, ‘Let him go and put them on.’ I let him go to put them on. As he turned to go, the Messenger of Allah, may Allah bless him and grant him peace, exclaimed, ‘May Allah strike his neck. Isn’t that better for him?’ He said (taking him literally), ‘Messenger of Allah, in the way of Allah.’ The Messenger of Allah, may Allah bless him and grant him peace, said, ‘In the way of Allah.’ “ Jabir added, “The man was killed in the way of Allah.”
